What are typical reasons for I485 denial?

No way to know until you receive it. But without an interview, I would guess they sent you an RFE you did not respond to (maybe it got lost). I assume you don't have anything that would pop up when they ran your fingerprints?

10.18.2010 - RFE response sent certified mail

They might have also missed an interview appointment, which will also lead to an automatic denial.

A timeline would help.

Timeline

Without an interview I would say the main reasons for denial are:

- A RFE that went without a response.

- An interview request that was not adhered to.

There is no way to know for sure until you get the letter.

My advice would be to next time you file or when you appeal etc is to do it on your own, without the middle man.

Hello!

I am German and got married to a Us citizen February 2012.We have been together for 7 years now. We are using an immigration lawyer to help us with the paper work to apply for my green card.

I just checked my status today and 4 of the 3 case numbers that I received were denied.

The lawyer has not received the official letter stating the reason for the denial yet but I was wondering if you could give me some information about reasons that you have heard before.

The income level is not a problem in our case.

I thank everyone that can help me understand this situation a little bit better.

That would not have resulted in an outright denial; they would have RFE'd him first.

Agreed. Not to mention, they are required to have an interview which is when they would ask for the bulk of evidence. Denial without an interview or RFE wouldn't be related to the relationship.

The question is such that it doesn't allow for anything but mere speculation.

Any section of INA that precludes approval of I-485 could be a reason as well as administrative error

on part of IO.

I would suggest OP to open a Google, type in "I-485 denied" or "my I-485 was denied" and then browse the

results.

You can find many (though far from all) different reasons why one or another I-485 was denied and read through

if interested.

I-485 RFE issued: June 25, 2012

Contacted offices of Honorable Senator Ben Cardin and Barbara Mikulski at the end of July.

I-485 DECISION MADE on August 03, 2012 , LESS THAN A WEEK AFTER CONTACTING THE SENATOR'S OFFICE TO INQUIRE ON CASE STATUS!

Wow, lots of bad info here. With a valid H1B you can travel outside the US, so that's not it. You have not been to the interview yet, so it's nothing about the relationship or anything like that.

The most common thing is that you got a RFE and did not respond to it properly (send back wrong stuff or did not reply). Did you get a RFE? Have you been checking the status often? WIth a lawyer, there are more places for things to get sent to and more opportunities for stuff to get lost (would be a lost interview appointment too). The only other option I can think of is that you are statutorily unable to adjust status, like you had a J1 before and you have a 2-year Home Residency Requirement you need to fulfill.

It's also possible you are checking the wrong case number.

We have received 2 RFE's both concerning my husbands federal tax return. We sent both back in time. The first we sent the same information we sent originally the second time we ordered an official transcript from the IRS. There should not be any problems with that.

Yes, I haven been checking my status very frequently.

It could certainly be that something did get lost. You never know, things happen.

I never had a J1 Visa before only F1 and H1B and I have been living in the US for 7 1/2 years.

Obviously, you did not send in the right stuff for the first either (It was a waste to send in what yo already sent, btw, because it was obviously not the right stuff!). You are lucky they even bothered with the second - they could have denied it right then. Did you send proof of current employment?

You have a lawyer, though, correct?

Yes, we did sent the proof of current employment.

We do have a lawyer and I am pretty sure that, at the least the second time, we did sent exactly what they asked for. I double checked the instructions.

Okay, but I still still bet the mortgage it was not correct. The timeline and everything points to this, specifically. Let us know when the letter comes.

It sounds like your travel outside the states, while permitted, may have cancelled your I-485 application and you may need to reapply.

But you need to talk to your Lawyer and ask him/her to verify the legal requirements and if you broke them by accident.

While Harpa wants to bet her Mortgage on her advice It sounds like she may need to calm down a little :)
