hi has anybody here had experienced the denial of I485 together with the EAD? I had been waiting for my green card and EAD to be in my hands anytime this month or next month coz i never thought they'd be denied. i dont know the reason yet for the denial but i've called the USCIS but the three people ive talked to said they did not have an access to the letter so i just have to wait for the letter which im expecting to receive anytime this week. I havent told my husband yet about this and i know he will be so frustrated about this. i was gonna freak out and couldnt believe at first when i read the status check online...but oh my.. what can i do.. i was thinking that was just a dream.. that i havent checked it yet and my green card and EAD is soon to come. lol..

i have not had interview..didnt receive any letter for that though. i had my 2 biometrics since they sent me another appointment letter after the first biometrics i had. i had my biometrics june 19 and july 16,2012.

what shall i do?.. i dont wanna be deported.. will i be?.. is the denial of AOS always have a second chance?like to appeal or send another or new I485 application?... i dont know what to do. ill just keep on praying everything will be fine soon.

another thing is if we file for another I485 would the processing time which supposedly should be 3-6mos to receive the permanent residency would take longer?since it's second filing?

i am convincing myself.. this is nothing and can be solved.. everything will be fine. hakuna matata. :D

and by the way.. i came to the US under k1 visa.

I am sorry for what happened.

As far as I know, AOS requires an interview after the biometric, if you did not receive an interview letter then my suggestion is that the letter was sent and lost in mail, as a result you were denied for not attending the interview, Nothing can be done if this is case.

Watch for the denial letter and see if it gives you any chance to appeal or reopen your case.

Hopefully we see other comments of similar situations.

is exceptionally rare that an AOS is denied, when adjusting from a k-1 visa.

do you have any sense of red flags about the paperwork that you sent off ?

and

did you get married within 90 days of arriving in the USA ?

when you call back into USCIS tomorrow, ask for and get an ISO , then ask the ISO:

1. do you have any returned mail pieces on me? (if so, go over the address again, ask for them to be remailed )

2. when was the denial letter sent out ? lets check the address again, just to be certain.

USCIS won't tell you anything you didn't know already(basically) through phone, they won't read an RFE to you and they won't read you the letter. Best thing you can do is wait until you receive the letter and simply re-apply, or follow Darnells advise. But read the letter first and see which reasons were given. Please post it here too.

Did the first set of fingerprints not turn out good since you had a second biometrics appointment?

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

As you were told on the phone, you can't really decide what to do until you get the letter... outside of tell your husband now. All choices involve spending a LOT of money... so he'll need warning, and of course time to comfort you.

OP, your situation is very frustrating. This thread is drawing responses; no need to create other threads that are essentially the same.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry for what happened.

As far as I know, AOS requires an interview after the biometric, if you did not receive an interview letter then my suggestion is that the letter was sent and lost in mail, as a result you were denied for not attending the interview, Nothing can be done if this is case.

Watch for the denial letter and see if it gives you any chance to appeal or reopen your case.

Hopefully we see other comments of similar situations.

yeah i just have to wait for the letter to know what caused the denial and act on it right away. :wacko:

what news from an ISO, about returned mail pieces?

See, here's the drill...

you get some things in yer postal mail, you've been to ASC appointments already.

But you got nothing past that. You should have received something past that date.

You didn't. You might have gotten an RFE, but since you never got it, and never responded to it within the 30 day window - it possibly caused the AOS casefile to be automatically closed. Failure to respond to an RFE is a big deal, FWIW.

It's a very good idea to chase down 'returned mail pieces' with USCIS, and that's best done with an ISO on the National Call Center hotline.

yes we got married as soon as i got here.. like after a week... i havent called the uscis again.. cant connect yet..

the denial letter has been sent aug 31. so i'll receive it probably today or tomorrow.

we've checked several times the documents we sent to them. we really dont know which one could have a problem.

my case still has hope right? lol

maybe yes that's y i had another biometrics appointment. do you think that could be the reason of the denial?
