Help, emergency!

Hi there.

I just got the call everyone doesn't want to get a 4.30 am. My American fiance was in a serious skateboarding accident and has completely broken his femur. He's going to be in a cast for between 3-6 months, and i am beside myself.

We just received our NOA2 a month ago, and received our tracking number last week. We have not heard from the Johannesburg consulate yet, so naturally I assume it's still going to be awhile before we hear anything. I thought about going to him on my tourist visa,(which i still have) but some internet research says that there is a 95% chance I will be refused entry.

I'm a freaking out. I need to get to him. He just skyped me from the hospital and he is so drugged up he can barely string a few words together. He heads out to surgery in the morning, but it is possible there may be permanent damage. My heart is shattering every time I think about him being in pain without me there to hold his hand and reassure him. He is scared and I need to be with him right now.

Is there any way I can speed up the process?

In a frantic cloud of google search panicking, I read about expediting my visa, but I can't seem to make any sense of it.

What can I do?

If anyone has any advice or suggestions, please let me know.

Thank you so, so much.

What I would do is to write an email to Jo burg consulate and explain the situation and hope that they will give you an early interview date.

It is possible to visit during K-1 process, I visited my fiancee before we got NOA2 but I am from a VWP country. Since you already have visitor visa (B-2 I assume), I think if you want to see your fiancé as soon as possible you have to take the risk and board a plane to visit him. Make sure you bring A LOT of proof of ties such as letter of employment, school enrollment, apartment lease and things like that.

Note that you will still have to return to south africa to finish your K-1 application.

Good luck

He only boke his thigh bone. People brake bones all the time. This is not an emergency situation. Unfortunately he will be in a cast for quite sometime but he will be able to return to work with the cast on as well if someone can assist him with transportation after a period of time. So what is the emergency?

I'm sorry if the title offended you.

I was panicking because the love of my life is incredible pain, and since the break is incredibly bad, like completely separate, he may not be able to walk for three to six months, and may have to use a cane for the rest of his life, according to a doctor.

Obviously, I'm a little stressed, and at the time that i wrote this, it felt like an emergency.

i'll be sure to title my posts my posts accordingly next time.

I was stressed, and upset.

My apologies.

that's awful, i'm really sorry. it's easy for people to get on their high horse, but i think most people would feel the same as you if their partner was hurt, scared and undergoing surgery! i don't know anything about the jo'bury consulate but if i was in your position i would probably just book a flight and try get there as a visitor - bringing proof he is in hospital, and of your scheduled interview etc. good luck and hope he gets well soon.

I am sorry to hear for what happened.

Unless its a serious life injury, nothing can be done and your research is fruitful since most of he time you will be turned away.

Unless you wana take the chance to be turned away,Try to stay in touch with him and encourage him as you can, this is the best you can do.

YA ALAH Bless Our Joureny To The End , Ameen

Thank you so much for your support.

I will call the consulate on monday, just to see how far along we are.

If we're not far along enough, I will leave as soon as I can. It's hard to prove employment because I'm a freelance writer, but we'll work around it.

He's about to go into intensive surgery right now, and in the painkiller haze keeps asking for me. it's so tough, but i guess it's all part of the journey.

it means a lot that you guys are so reassuring and quick to respond.

Glad to have a community that understands, despite some snarky people who are intent on sarcastically minimizing stressful situations.

Wil keep you posted on the situation.

thank you again.

Even if you manage to get the interview expedited and get the visa as quickly as possible, it's likely he'll be finished with surgery and out of the hospital before you get to the US.

I agree with Krikit. Go ahead and try to visit. Besides the normal proof of ties evidence, try to get his doctor to fax a letter to you explaining the nature of the emergency. If the CBP officer is inclined to deny you entry for suspicion of preconceived intent, he would still have the option of granting you humanitarian parole. I've heard of people who were waiting out a 10 year ban getting paroled into the US so they could visit a seriously ill relative.

The chance is too high you will get turned away at this point if you try to visit, it's not worth the risk. And since his injury isn't life threatening, the likelihood that they're expedite it are slim to none. As it should be. I don't mean any offense, but this isn't an emergency that warrants an expedite. That might sound harsh, I don't mean it to be, I'm sure any of us in your situation would want to get on a plane and get here, but we don't have that luxury.

If you want to try a tourist visit, be prepared that they not let you in, being as far along in your visa.

i think it makes sense to delay your fiance's entry INTO the USA until he's recovered from the surgery and the cast is off.

In the meantime you should revisit yer SA visa, see what's up to get valid entry back into SA.

Good Luck !

OP is the beneficiary. The USC petitioner is the one who is in the hospital.

Jim - what? I got it backwards ? aiyo.

to the OP -

to get into the USA 'faster' on the K-1 visa -

you'll need to get it approved faster,

and 9 times out of 10, that means you need to get an earlier interview date at the IV Unit.
