hi i need help regarding my case any suggestions will be helpful here is my brief story;

i am naturalized citizen, i got my greencard through marriage this year in march2012. i got divorce in march2011.i am in india now.i just meet my old girlfriend who has my baby of 3yrs old. i know i had relations with her in 2008 but i never talked or visited after that.she didnot knew my address in india,she just knew that i am from america.but coindetally she met me in a market ,where she told me about my boilogical baby.now i want to marry her & apply for my baby. so what should i apply & how?

whats the best way to bring my baby & my girlfriend to usa? all ur answers will be very helpful to me plz.thanks in advance

well technically the fastest/easiest way would be CR1. marry in india and file from there, that should take about 4-5 months. not sure if your own immigration history will raise any flags though.

Are you listed as the baby's birth father? If not that can create some problems. You may want to check local laws because both parents have to give consent of a child to leave or immigrate to another country. If someone else is listed as the father then you may have to get a local court to declair the child as "abandoned" by the stated birth father.

If you are listed as the father then contact the US Embassy as the child may already be a US citizen.

Not sure if read this correctly but..... You married a USC. Immigrated. Got Green card. Divorced your USC. Now want to marry and bring into USA your "former" girlfriend and your 3 year old child??

Be prepared for an uphill battle ....

That sounds like a typical fraud scenario.... I would be surprised if you are successful in this....

Marry in India, file an I-130 for your wife and child. Depending on when the child was born, the child may be entitled to US citizenship through you.

The fact that you got your green card through marriage and recently divorced will be a major red flag, and don't be surprised if they suspect fraud.

There have been plenty of cases of a foreigner fraudulently marrying am American, getting their green card, divorcing the American and then marrying their old gf from back home. They are aware of this, so make sure you're able to prove your past and present marriage were both bona fide.

I'm not going to judge you, but I'm going to show you how an immigration office may view this.

I have some questions, though: Are you a naturalized citizen or a permanent resident? You can't be both. You said you received your green card this year in March 2012, but you stated previously that you were a naturalized citizen. A naturalized citizen of India, perhaps? Or were you born there?

Yours is such a complicated scenario that you probably don't even realize that there are so many facts that an immigration officer would need to know before they could admit your new fiance/girlfriend. When were you married at first, and did you have the baby before you were married? If you had the baby close to when you were first married, then the immigration officer may seem suspicious of your previous marriage, that it was entered into in order to enter both you and your girlfriend and child into America. If you were married something like 10 years ago, and the marriage just didn't work out, then you might be okay.

Something doesn't add up here, though. How did you get your green card through marriage if you were not married (divorced in March 2011, and received green card March, 2012)?

You are right, you have to be legal resident for 5 years...

e.g. A spouse can come on CR1 or IR1 and gets citizenship in 3.5 years, and in the meantime, gets divorce..... but to apply for immigration for new spouse, they have to wait for 5 years from the date they became legal resident.

Never knew of this condition...

i got my citizenship this year 2012.i was permanent resident since 2007,so 5 yrs have already being passed.i was married to us citizen only.i am planning to get married in india with my GF, from whom i have one 3yrs baby.i met her after almost 4yrs.i am biological father of tha baby & birth certificate has my name on it.so now what should i do for then to immigrate to usa.

Did you also read further, past the UNLESS.

The OP states they are a naturalized citizen, even though they only got their green card three months ago. Something is amiss here.

Something is wrong with your dates above. You say you got a green card through marriage a year after you were divorced and that now, after three months with a green card, you are a naturalized citizen. Not any of this is actually possible.
