How about get married in the US, apply for AOS, then with the AP in hand fly to Thailand and do the tranditional wedding?

If the OP went the K-1 route then did this that would be fine, though they would already be married when they had the "traditional" wedding.

I wasn't suggesting marriage on the tourist visa, but on K1. I think it is easier to adjust from it too.

Btw, who are we kidding, many people bend the rules and there is no lifetime ban involved. We were dating, but then we decided we ust cant be apart and he proposed, even though I had all intentions of going home afterwards.

Absolutely true. However, it's not something I'd advise people do. If people feel like breaking rules and spending the rest of their lives looking over their shoulder and hoping they don't get 'found out', then that's their choice. Still not something VJ should advise, even though I know you didn't mean it that way. :)

I agree with this.. I also stopped right there because that is the biggest NO NO.............. And NO this is not a "frowned upon" situation... these are facts and visa restrictions.

You can file the K1 while she is the US visiting. Keep in mind that the entrance to the US and length of staying are not always 6 months; and CBP agents can give her less time or deny her entrance at POE

One more thing....as she is coming in the country; either she will be together with you at the inspection point or on her own.

If together, the inspector is bound to ask why are you together (are you married, friends, etc) and it is VERY important you tell the truth, which is, girlfriend and your K-1 plan. At that point, it is possible admission is denied. It will not affect the outcome of the K1 by the way (unless you lie to a direct question)

If she is on her own at the inspection point, it is also likely she would asked why is she visiting and for how long; and as before, truth is VERY important. Saying 6 months (or about 6 months) might prompt other questions; She would also have to say to spend time with boyfriend while K-1 is in process. Inspector might deny admission in this case too.

Not trying to scare you or anything; not saying you are trying to do something borderline fishy, in fact your plan is sound -except for the marrying in Thailand, which you've been told will invalidate k-1-; but trying to relate that inspectors have sole discretion of admitting people into the country and this could go South if direct questions are asked.

Think carefully about what you are planning and decide accordingly. Unfortunately, there is people out there who tries to go around the process by coming on a tourist visa and end up staying (married and all that); so everyone is then pressumed to do same.

Actually the way you did it wasn't bending the rules at all, what you did was perfectly legal, that's why the provision to do so exists. My wife and I did the same thing, we had been doing the ldr for almost 2 years, she took an extended vacation from work and came to visit me during the summer for 2 months, it was supposed to be a trial run for us to see how we would work together for more than a week at a time. It went so well and we were so tired of being apart most of the time that I proposed 2 weeks before she was supposed to go home. She stayed, we got married 3 months later and did the AOS. It cost us a $600 return ticket, but that was money well spent compared to the alternative. It's all in the intent when crossing the border, if you lie and get found out, you pay the consequences.

We will file for the K1 while she is in the US however she will return to Thailand once it is done processing or her 6 months is up.

We will NOT get married in Thailand, we will only have a party with her family to celebrate our FUTURE wedding in the US.

Wow I did not think I would get so many replies in one night.

Let me clarify a few things.

We will not be getting married in the US while she only has a b1/b2 visa.

We will file for the K1 while she is in the US however she will return to Thailand once it is done processing or her 6 months is up.

We will NOT get married in Thailand, we will only have a party with her family to celebrate our FUTURE wedding in the US.

Feb 2013 I fly back to Thailand to get married for her family then she flies back to the US with her K1 and we get married in the US for my family and to fulfill the K1 requirement.

that made the confusion, just say engagement party not get married it is a big difference if that so then you're still in good track, never get married in Thailand while she is in K1 visa. i am also thinking maybe it will be a problem if you go together in US, at the immigration they will ask who are you are you friends or gf/bf if they found out that you are going to file for k1 or something like that then she might get denied entering US using her b1/b2 visa. sorry for my english i am not that really good but i am trying my best to explain. i already have a friend that got denied entering US for almost the same situation, by the way good luck on your visa journey :)

We will be flying separately into the US however she will say that she will be visiting me and staying with me however she will bring all of the documents that she gave during the interview as well as her return ticket.

This is what my fiance and me are planning to do, Once she and my new daughter gets here in the states we will get married probably the first month(small wedding)and after we get the AOS done so they can leave and come back we plan to get married there in the Philippines (big wedding)for her parents to be able to be there. That way it's all legal and I think it takes longer when you do the I-130 than the I-129 so that's why we are doing it that way. Hopes that helps? Good luck on your journey and God bless.

Considering that is not what you said in your original post, you can see why we were confused

Be careful, if the Thai government 'thinks' you are married then they can deny your visa. I've seen couples denied a visa for referring to each other as 'husband' and 'wife' in communication although no ceremony took place. If it were me, I wouldn't do anything to hinder having my spouse in the US
