I just went to uscis.gov's website and entired the search criteria to find the estimated processing times for I-130 petition for marriage/spouse and it says estimated time is 13.9 months!!! :wow:

Then I entered search criteria for 129-F petition for fiance and it says 5mos! Why the enormous discrepancy here???? This seems to me to be grossly unfair. They receive more petitions for 129-F and yet the processing time is faster? Really?

Can someone give me some insight as to why this would be? Because that's just ridiculous in my opinion. :wow:

It might have something to do with the fact that the I-130 is an immigrant visa, and the I-129 is non-immigrant, and processing works differently between immigrant and non-immigrant visas.

I went today just about 20minutes ago. I was checking Vermont SVC which happens to be the one that mine is located at right now. I should have pointed that out in my original post sorry. But processing time is over DOUBLE there for marriage visa petitions/ fiance visa petitions. And before yesterday...even for Vermont it was shown 5mos processing time for I-130's. Why the huge change is what I'm wondering. All of a sudden it changed.

Processing time for I-130 has never been 13.5 months. I don't know what you were looking at. but I-130 petions have the same processing time as I-129 petitions (5 months).

Yeah, I-130 for Permanent resident filling for a spouse or child under 21 is around 14 months, but anything else is 5 months.

Timeline

The K-1 does not produce a green card nor go through a green card process like the CR-1 does before they enter the USA. The K-1 has to apply AFTER entry and marriage which adds another 4-5 month wait for LPR status.

CR-1 does the process at the NVC which takes longer causing their longer processing/process and CR-1 entrants get a green card on entry to the USA auto LPR status.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

When I was checking before (maybe a week ago) the estimated processing time for Vermont SVC I-130 petitions was 5mos. I'm wondering why the big change all of a sudden?

Can you provide a link to where you found this information?

According to this USCIS Processing time site the wait is 5 months for an I-130 petition for spouse or child under 21 if the petitioner is a US Citizen:

Also, while there may be more I-129f visa petitions on VJ there are a lot more I-130 petitions submitted each month to USCIS.

06/10/11 - Married

USCIS: (224 days)

07/22/11 - Mailed I-130 petitions for wife and step-daughter

07/28/11 - NOA1 for both

02/21/12 - RFE for both (received hardcopy on 2/25)

02/28/12 - Responded to RFE for both(received by CSC on 2/29)

03/02/12 - NOA2 for both(received hardcopy on 3/8)

NVC: (37 days)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

04/04/12 - IV Packets reviewed. Checklist issued for Divorce Decree for my wife. Step-daughter's was accepted and her case closed

04/16/12 - Expedite requested for both cases due to NVC error

04/18/12 - Expedite request approved for both cases and sent to Santiago Embassy

Embassy: (15 days)

04/24/12 - Embassy received both cases from NVC

04/25/12 - Wife went to Embassy for document review. Interview date assigned for both cases.

04/26/12 - Medical Exam for both. Result - approved.

05/07/12 - Interview date for both. Result - approved!

05/09/12 - Received both Visas

05/16/12 - POE Atlanta
