my husband came over from scotland and we filed the AOS and work permit paperwork, since then they have sent me 2 requests for more information regarding my income. My aunt and i are filing jointly to combine our income to show that we make enough to keep him here. Its been 2 weeks since i sent off my bank statements and i am worried that it still wont meet the requirements of income. what should i do if they tell me neither of our incomes combined are enough? my aunt and i both work full time jobs and get payed what i think is very well, plus once his work permit gets accepted hell also be working a full time job making good money too. i dont understand how that couldnt be enough.

Do you and your aunt live in the same household? I ask, because in order to combine income you would have to be. If this is the case, did you fill out a I-864 and your aunt a I-864a?

The problem might be that an aunt is not eligible to file the I-864A to combine her income with yours unless you claim her as a dependent on your taxes. The instructions state "A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling. A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor."

Either you need to have enough on your own for your household size plus your husband, or your aunt will need to have enough on her own for her household size plus your husband. She will need to fill out the I-864 just like you. If she does not make enough on her own either, then you need to find another joint sponsor that does qualify on their own, if you do not either.

Your husband's future earnings do not count, but if he has savings or other liquid assets, those can count.

An aunt is not an eligible household member to use an I-864A. She must submit an individual I-864 (in addition to the petitioner's) and prove income sufficient for her household plus the intending immigrant.

The immigrant's future income is not relevant.

How much money do you, the primary sponsor, actually make, and what is your household size, other than you and your husband?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

okay, when i first filed all the paperwork for his aos, my aunt filed the i-184 herself, they said that she didnt meet the poverty level(?) and requested that i either file jointly with her or find another filer with a higher income so i decided to file with her. i sent them all the requested information for that. then they sent me another request asking for my bank statements for the past year so i sent that in 2 weeks ago. since then i have not heard anything else. i am worried that they wont except it and if they do what shall i do about it because we both have normal full time jobs. no body in my family are millionares but we are all in full time work and are comfortable with money our situations. if they wont approve 2 full time workers pay income then what will they want because i figured that would be enough. i guess my question is, if they dont approve it then what should i do next?

You only need to make 125% of the poverty line for the amount of people in your household, if you are getting paid "very well" this shoudn't be a problem unless you have an excessive amount of dependants.

How many people in your aunt's family? What is her current income? Use the I-864P link in my signature below to determine the income requirements.

I make 19,200 per year and in my household there is me my husband and our child. My aunt makes well more than I do around the 28,000 per year and she has herself, husband and one child in her home.

Household of 3 (you, hubby, child) requires $23,862

Household of 4 (aunt, uncle, cousin, + your hubby) requires an income of $28,812

If your uncle is also employed then he can file an I-864A along with your aunt's I-864 to combine their incomes to meet the requirement.

How much money do you, the primary sponsor, actually make, and what is your household size, other than you and your husband?

I make 19,200 per year and in my household there is me my husband and our child. My aunt makes well more than I do around the 28,000 per year and she has herself, husband and one child in her home.

So then, your aunt would need to look at the income guidelines for a household of four (her, her husband, their child, plus your husband), which is $28,812.

You are not eligible to combine incomes with your aunt!!! She doesn't qualify to use the 864a along with your 864.
