I just got a letter in the mail that states the following.

September 29, 2006

Upon receipt of your letter requesting expeditious handling, this matter was reviewed and a determination was made that it met the criteria for special handling.

The petition/application will be reviewed and you should be receiving notification from this office very shortly.

Bla, Bla, Bla,

Man I am so glad that I didn't listen to the people who told me I was wasting my time with an expedite request. I'm really glad that I contacted more than one elected official, because everyone has there own way of presenting things. One of my Senators simply made the inquire while the other Senator actually mentioned something about an expedite in her inquire. You all can say what you want. All I know is I'm glad I did everything that I did. I'm glad I listened to my heart and followed through with my case. I'm glad I didn't take "nothing" as an answer. I think this goes to prove that when theres a window of opportunity, take it. The USCIS phone line said 60 days to process the RFE, they were outside of that time. One of the conditions to order an expedite request is "Compelling interest of the USCIS". I guess I struck the right nerve.

Thank you so much Kirsten for helping me with the letter.

I hope everyone can stop jumping my case when I make suggestions, because it obviously worked. My Expedited request sent on the 26th, responded to on the 29th, and an NOA2 date of October 3rd.

There is a difference between being patient and being passive!!

Ohh, I forgot to mention the other part of the "compelling interest of USCIS." in my eyes was the fact that they sent me an IMBRA RFE even though I used the new forms. That kind of rubbed me the wrong way as well.

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

Andy, you did indeed have good reason to ask for expedition...and I am DELIGHTED to have helped you. I agree. There's a difference between patience and passivity. You knew your rights, and you stood up for them. The letter you sent was entirely calm, respectful, and dignified. I'm really happy to see the text of the response you got back. Your efforts paid off!! Makes me smile all over!!

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

I missed the backstory... What rational did you use that made them say... YES!!!

Since I helped Andy with his letter, let me first explain that he was not at all out of line in sending the expedition request. Nor did he lie as someone, perhaps jokingly, implied. He simply held USCIS to their own published standards. To clarify: He received an RFE that he should not have received in the first place; he nonetheless complied with the RFE; after doing so, he heard nothing within the promised sixty days. He thus engaged congressional support and made the request for expedition invoking his rights under USCIS's own proceedural guidelines. He was honest, calm, concise, and straightforward in his communication with the involved parties. It worked. I applaud him.

This was not about finding loopholes. It was not about repeatedly pushing buttons he shouldn't have. This was simply about respectfully holding USCIS to its own promises and standards. End of story.

That's great! I'm very excited to know that someone finally received some justice, and I'm happy that you were there to assist. Lord knows that we need one another. Of course he received justice only after going through the fire, but what's new. By the by, there's nothing wrong with a loophole here and there as long as it's ethical and doesn't set someone else back. LOL! I applaud you both...

Sure i am personally glad of the positive outcome. The part i find obnoxious is the absolutely immature approach of rubbing it in to those who may have expressed pessimistic views during his quest for this outcome.
