I think the OP is wondering whether he will be picked up and deported, it has happened.

That is why we need the visa type, and current status. For instance, if the OP has filed for AOS, then he/she is able to travel within the US while the case is being adjudicated. Just bring a copy of the receipt to show when you have filed.

Don't get caught, and leave before you are 180 days past your expiration date, if you want to come back to the US without incurring a ban.

Or, if your 1-94 wasn't expired, you need to get a new one. You need something to prove your legal status if you get checked, unlikely as that may be.

Probably OP is dvised to stay out of AZ and a few states in the deep south LOL (nothing there to see anyway)

Probably the OP should be advised that in some U.S. airports, CBP/ICE agents hang around the TSA area. Being pulled aside could result in unpleasant consequences.

The OP is also advised to avoid internal CBP checkpoints.

It's hoped that these answers are more informative and meaningful than the one first quoted above.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Depending on how long you are planning to stay around, I'd see about getting an I-94 replacement, when you leave the country, it is the record that you actually left, so at minimum, if you do not get a duplicate one, I'd check with the Embassy at Warszawa about this; small things like this can turn into big problems later.

It is not likely, but sometimes at airports, they do check your passport looking for the visa and might even ask for the I-94. Some are aware that while Poland is in the EU, it is not in the visa waiver program. Happened to my wife, twice already, different airports, only difference is that we are in AOS and can show USCIS notice and our marriage certificate, and if need be, I calmly ask them if they know how to spell 'attorney'.

Just recently, in Texas, a teenager (a USC) was deported to Colombia in a mistake. SHe help it by lying, but she was deported.

If someone does pull you out for questions; at some point, they hopefully will contact CIS and can check that in fact you are ok; but it will cause you to lose your flight and other delays.

I m guessing wht op is referring to is her Visa and I-94 both are expired, somehow she got her embassy to issue her a new passport within US.

Travelling within US on expired Visa is like taking a chance, depends on which TSA agent you get, sometimes they go thru passport, sometimes they don't.

Also varies from city to city some places CBP and TSA officers work togeather.

Also on side not OP you are not eligible for SSN card on B1 visa and anyway it does not prove you are present in country legally.

I guess you are used to taking chance since you are living illegally with your expired visa, I guess you can take this chance and fly too. :)

If your visa has expired, but you are still within the time period stamped on the I-94 you should apply for a replacement I-94. USCIS handle this, for a fee. If your visa has expired and your I-94 period has also expired, you run the risk of being picked up and deported if you are inspected. It's not usual to be inspected on internal flights, but if you are flying near or through border cities there is always a possibility of random inspections.

I don't have a valid visa. I don't have a social security number so I cant even get a state ID... only picture ID I have is my passport that has been reissued a few weeks ago so there's nothing in it. Can I still fly within the Unites States without being asked any questions?

So if you don't have a valid visa are you here legally? or did you overstay ur stay...i would say NO!

I'm guessing you have overstayed your visit something lots of Polish/but not only do! Not a big fan of such people since others have to go through much trouble to get there loved once here, the legall way. Sure you can travel on LOT airlines to KRK:) Good luck kolezanko:)
