My fiance went on his interview on Friday. After providing his proof of relationship, Immigration Officer asked him for more proof. My fiance asked him what more proof can he give? He had phone records, Western Union receipts, Pcitures, Letters, and Proof of my last visit in July. The Immigration Officer asked him why didnt I come back after July? He told the immigration officer because I started a new job and couldnt get the time off from work. So the immigration officer told him that they will have to conduct a background check on me for more evidence. They handed him a white sheet stating that enough evidence wasnt presented to believe that we were in a legitimate relationship. The officer told him that after they do a background check on me they will call him back and make sure he doesnt lose the paper because he will have to bring it back with him to the embassy when they call him back. I am totally confused. Is this the Ap process or what? Was he denied or what? I was told usually when a person is denied their passport is stamped. His passport wasnt stamped and my fiance said during the interview they fingerprinted him. Please somebody let me know what this means.

I would look at other Jamaica threads, review the guides,as the interview is so important. It does not appear a good sales job was accomplished, and he should be better prepared the next time. I am sure other Jamaica members will have more direct information on the embassy.

i thought background checks on the USC where finished by this stage??

fingerprinting is normal.

all you can do is wait for the extra checks to take place i guess

Well actually from my fiance reading the paper out to me. It states they will send the petition back to the USCIS which means that everything is going down the drain.

Sounds like the IO didnt think it was a bonified relationship from the proof presented. Have you contacted the embassy to see if they will do another interview with you there? Im confused from your timeline though it says you were approved 11/01 and are writing this post today? Did you already have another interview? How many times did you visit him and did you go to the first interview? you might want to get your congressman or woman involved and try not to let it get sent back. When does your petition expire? Do you have any more info from your fiance on the questions asked. Is there an age difference or any redflags?

Well, just be sure that you have a complete scanned copy in yer email of all of the documents that were given to yer fiance on interview day.

Then YOU review them.

When the notice says they are sending the petition/file back to USCIS, that's a hard denial. In a few months, USCIS will contact you with the reasons and give you a short window of opportunity to respond. Now is the time to begin preparing the response.

Well, now that he finally read the paper to me, I emailed the U.S. Consulate in Kingston requesting a new interview date. His interview originally was supposed to be on the Nivember 1st but had to get rescheduled to December 23rd. Then he asked him to show him proof and my fiance showed him pictures phone records western union receipts. He asked him why we dont have anymore pictures and my fiance told him because the othre pictures are in his phone. Then the IO said to him well they have to do a background check on me( the peitioner) for further evidence. Then he gave my fiance a white sheet of paper stating that he wasnt convinced it was a bonafide relationship and that the peition will be sent back to the USCIS for further investigation then resent back to the Kingston Consulate. He gave back my fiance his passport book. But, my fiance believes that he wasnt denied because they didnt stamp his passport book which I think is irrelevant.

Sounds like the CO thinks the relationship is fraudulent. The pictures answer is an excuse. I had over 1,000 pictures on my phone. So did my fiancee. We both downloaded the pictures and emailed them to each other. Then, printed them out. Probably that lifted up a red flag on the CO's mind, thinking the answers were phony. Only one visit is an issue in high fraud countries. I think you should sit down with your fiancee and ask him every detail regarding the interview. What was he asked and what were his answers? Was he nervous? Even ask him what did he wear?

Were you married before? Do you have children? Do you make 125% above poverty line? Western union receipts may be a red flag as it may lead to the assumption one party is paying the other for the fraudulent relationship. I've read many times in these forums that any financial transactions as such (western unions, canceled checks, etc.) are NOT recommended to be presented as evidence.

It appears you are tying to spin or interpret what the notice says. If they are sending it back to USCIS, then the visa has been denied. See my earlier post. Yes, it is irrelevant that they did not stamp his passport. They don't do ANYTHING to the passport when denying a visa. What you need is an actual copy of the notice your fiance was given. When you read it and interpret it literally instead of "favorably" you'll understand that what I told you earlier is correct.
