Is it possible for a service centre to misplace your K1 Visa application?

We filed in June and are with Vermont, so it is now almost 6 months and 2 weeks since our NOA1.

Seeing many being approved for their NOA2 that have filed in August, I find myself wondering as to why we are still waiting for our NOA2?

Is it lost or forgotten someplace?

I realise that others are waiting also, others that have filed even earlier than June evenso, the frustration and disappointment is still ever present.

I have read that the USCIS processes in order of receiving, :huh:

I am beginning to really think ours may have lost its way somehow! :(

Have you received your NOA-1? If so, your petition is not misplaced, it is merely waiting in a pile of others to be adjudicated.

If you have NOT received your NOA-1, an infopass appointment is highly recommended.

Sadly, there are still a few June filers waiting, even several April and May petitions that have not been approved.

In THEORY, USCIS processes peitions in order that they are received, but if you've ever looked at Igor's list you'll determine that there is no rhyme or reason to the adjudicating order of petitions...

If you are really concerned you can have the petitioner put in a request with his senator/congressman and figure out where it is.

I'm sure you've called to put in a service request?

I have read that the USCIS processes in order of receiving, :huh:

Yes and no. They put the petitions into boxes in the order received, and those boxes are lined up chronologically. When an adjudicator is ready for more petitions they pull the next box on the shelf. After that, practically anything can happen. Some adjudicators work faster than others. Some adjudicators end up spending a lot more time on one box because one or two petitions are extraordinarily difficult and slow them down. They might not set a difficult petition aside until they reach a point where they're waiting for information from another government agency or a response to an RFE from the petitioner, which slows down processing of the other petitions in the same box.

In short, one adjudicator could be working on petitions in one box while other adjudicators are working on petitions that were received weeks or months later. If your petition happens to be one of the difficult ones then it could end up being set aside pending the receipt of additional information while other petitions are processed and approved.

They do sometimes lose petitions. They also sometimes misplace evidence that should be with the petition. There's not a heckuva lot you can do. Put in a service request when you're outside the normal processing window. Contact your congressional representative's office if they take too long to respond. Keep yourself occupied while you're waiting. If they lose the petition then they'll eventually admit it.

i think the service centres lose their way sometimes... petitions probably not so much.

Part of the process is doing background checks on each person, until everything is good with those the file sits, some people have more interesting backgrounds then others or names that are "similar to a less desirable" that needs to be addressed.

Seems slow, but put in a service request. Like Jim said, depends on lots of variables, some get lucky. Keep checking, have some Christmas cheer.

Of course anything is possible but given recent timeframes it is highly unlikely anything is lost.

No, it is not possible. This is because "service centers" do not receive or process visa applications. It's possible but highly unlikely that your PETITION has been lost. After the petitions are approved, the foreign fiancee will apply for a visa with a Consular Immigrant Visa Unit abroad, not with a service center in the USA.

The problem is that people assume "first come first serve" means everyone else has to wait if they have a problem, Not so. The grocery store will tell you they serve people in the order they get in line and it is true. They do not serve them in the order they came through the front door.

Jims description is exactly correct.

The adjudicator handling YOUR case may have taken a couple of boxes, including the box with your file, 3 week ago into their cubicle. They then went on vacation for two weeks. Meanwhile another adjudicator does not go on vacation and goes there today and takes boxes containing files from a month after you filed. Once assigned to an adjudicator the file stays there except for some extraordinary circumstance (maternity leave for example)

"Why not redistribute when some one is gone?" For how long? One day out sick? 1 week vacation? 3 weeks vacation? The department head just has to make a judgement call. But what if Sally Adjudicator was just taking YOUR file out of her box and the supervisor walks in and says "Here, Bill Adjudicator went deer hunting, do his files first"

Passing them out to many adjudicators in the order they were received is the best they can do, it does not assure they go out the door in the same order they came in
