Yeah I think we'll put in her application before her visa expires to stay above water. My friend told me that her friends were in a similar situation and they "forgot" to put the application in on time and had to get a lawyer to sort it out.

Looks like I'll be applying without a job and hope it goes through based on assets. If it doesn't I'll have to talk to my sponsor.

Her assets amount to about $500, but I thought every bit would help. I'll likely leave it off.

Your wife having $500 of assets in her own account is not going to make USCIS think she "bought" a green card. Things that make USCIS think someone "bought" a green card are situations where right around the time of marriage, the wife or wife's family suddenly give thousands of dollars to the USC, etc.

I had an important thought as I was going to bed last night... can I count my IRA in my assets list for the I-864? If so that'll make a big difference. I'll see what info I can dig up...

And thanks to the mods for all the help

edit: well the form does say all stocks and bonds- which is what is in my IRA. It seems like it's up to the officers discretion if it's considered "liquid" enough. I'd say an IRA is quite liquid given you can pull it out at a penalty any time. I'll plan on including it and see what happens.

Do I need to provide copies of my balances in my accounts when I send the i-864 in?

Yes, you will need to provide proof of the amount of cash money/assets/income you will use to meet the requirement. If you are using money in an account, you will need to show proof of the account balance.

Update:

I didn't get an RFE due to not meeting the income requirements, so it seems my IRA inclusion was accepted. I found a job shortly after our application was put in, so I'll be bringing my last two pay stubs to our interview, which is TODAY!

Interview was lengthier than I expected. There are two sections in the San Jose office- one for AOS and one for Citizenship interviews. We went to the AOS side but the lady who interviewed us came from the Citizenship side- she walked us through the other side on the way to her office. I don't know if this means she was more thorough than an AOS interviewer or not.

We got called a few minutes after 2pm (which was our appt. time) - there was hardly anyone there- 6 people or so. (I guess 2pm is one of the last appointments as they're open 7am-4pm). The interviewer spoke pretty standard US English without a heavy accent, which is something my wife was worried about. She asked my wife a few basic questions (DOB, parent's names, etc) and then started questioning us on our relationship.

I did the majority of the talking and the interviewer asked about how we met, why we decided to live in the US, when we decided to live in the US, etc. She made copies of our joint credit cards and health insurance cards and took a copy of our joint bank account statement. (we did not have any of these things at the time of application). She also took a copy of a lease that should have been in the packet, but wasn't.

I also didn't have a job when we applied, so I brought the pay stubs I had so far (only 2)- she asked if I had the contract. Which I did not- so I may end up with an RFE for the contract.

She said at the end that she'll make a decision and let us know, and she'll get in touch if she needs more information. I hope that at a worst case she asks for my employment contract- that was the only sticking point in the whole interview.
