I just looked through all the timelines and have determined that I am one of, if not THE, person waiting the longest time for K-1 petition approval in the history of VJ timelines.

Many of you know my story; if not, I don't feel like typing it again so feel free to read through my past posts. Basically, there is no reason for this wait. Neither my fiance nor I have a criminal background of any kind. We are both young professionals with professional jobs, never been married, no children, four year long relationship that includes over a year living together in his country. Fiance already has a valid tourist visa, has never entered the US illegally nor overstayed. There is no conceivable reason for this delay.

And yes, I have already tried everything, multiple times: service requests, InfoPass appointments, contact with my congressman.

We are tired of waiting. We are frustrated. We are fighting. We are sad. My very last resort is to contact an immigration attorney, but I am not sure they will be able to do anything for us.

Has anyone been in this situation and does anyone know if a lawyer could assist us in getting an answer?

K-1 Visa Journey

October 1, 2010: I-129F sent

October 5, 2010: I-129F received

October 12, 2010: NOA1 e-mail received, routed to VSC

October 16, 2010: NOA1 hard copy received (dated October 7, 2010)

April 18, 2011: RFE e-mail

April 20, 2011: RFE hardcopy received

April 20, 2011: RFE response sent to VSC

May 2, 2011: E-mail confirming VSC has received RFE response

July 27, 2011: NOA2 e-mail received (9 months, 2 weeks, and 6 days (292 days) after NOA1

August 4, 2011: NVC received case

August 8, 2011: NVC forwarded case to US Consulate in Ciudad Juarez, Mexico

August 8, 2011: Consulate received case

September 20, 2011: Interview! Not enough information in the system to make a decision

September 26, 2011: K1 visa approved and received via DHL

October 20, 2011: POE at Phoenix, Arizona

October 26, 2011: Married

You can file suit with the court asking for a Writ of Mandamus, if granted it would compel the USCIS to make a decision on your file.

I don't feel this is DIY territory, speak with an attorney about it.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

Hi Monyfer, I totally understand your stand and feelings on this situation. I do not know much on this area, but even as you consult any authority or attorney concerning the situation I would love to encourage you to call unto God for His mercy on your situation. HE is able to do all things. It is not late for God to come in. Cry unto God and believe me you will hear good news. I pray for your approval

im sorry about your long wait.....an attorney can not make it go faster...you can go thru all of the hoops as in ombudsman, congressman, senator, and asking for service request you could also try to have it expedited because of it being out of the time line they say it should take....you want to be careful with Writ of Mandamus because if they are telling you its in security checks it wont do you any good its a black hole loop they use and you can not do anything until it is cleared...(we had an attorney)...but one thing i want to stress.......when your noa2 comes and your s/o has interview attend it with your s/o we also had no criminal back ground or anything that would make our wait so long and it was a two year wait in the end i followed the guide lines that gogo has on his profile including contacting the white house and faxing our petition to them at their request...

just hang in there and try to stay busy ......i used to hate it when people told me that.....but you want to keep your relationship alive dont give up as long as both of you are committed and trying to stay positive it will turn out ok.....never give up

Gosh, I hope so!!!!

you can always ask an attorney the problem lays with the service center once the petition goes to it ......its up to the service center we had an attorney they cant do anything other than call and ask about the petition......some attorneys will give you the we can get it processed faster blah blah blah but they hold no special place that allows their clients faster response.

Did it really take TWO years for you to receive NOA2? What did they tell you in all that time? That you were in background checks/security checks? This really scares me!

dont be scared :) i looked at your time line you have had some rfe's i feel pretty sure you will receive your noa2 pretty soon.......we didnt receive any rfe in our case........there has been one other case that i know of that took as long as ours did in fact it took longer but there was a good reason for it.....it never did receive noa2 they received a denial of the petition and they left vj about two years ago i still keep in contact with her......

Sara is probably at once the sweetest and strongest VJ member that I know. Even while she was going through her own situation, she offered strength to others, as she's doing for you, and you can take comfort from it. It's tough for you, heaven knows, but keep the faith, si man. :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My fiancee filed the petition last sept of 2010 we are also asked for rfe..we thought that the person we get tht will help us through the process will do everything but we were wrong. unless u call and ask the status she wouldn't respond! we sent the rfe last may now everything's ok because we did it ourselves and on august 4 will be my interview. .just keep following up your case and one day you will find yourself in his arm.

I am so sorry and i cant belive you are still waiting :( and i was crying coz the 60 days since we sent the RFE pass. I dont know why they doing this since as you said there is no reason!!!! Maybe an attorney can help or at least tell you what to do. Do not give up, i can understand what you both feel inside as everyone else who is or went through this process but keep your faith in God, in you, in him, in both of you as a couple. You will be in my prayer and i hope the approval will come soon. Best whises

i thought we are the longest people waiting for our noa2. its been 4 weeks since rfe reply. i think expedite is for life threatening situation. we tried that too. seems like all we can do is wait. like you we are both professionals, he's an engineer, im a software qa, 5yrs gap in age, and im carrying his baby going 5 months now. we have a lawyer and i dont think shes any help to us. all she did is staple our papers, sent to uscis, and there we had rfe.i just hope uscis knows what they are doing.

Just get married and file IR-1 petition and scrap this one.

This is what we are planning to do. Fiance and I have decided if we haven't heard by a certain date (which isn't too, too far off) that we will just give up on this and I will move there and we will get married, and file for DCF for the CR/IR1 down the road...we needed to take some control back in this process and we feel good we at least have a time frame for us, even if USCIS won't give us one.
