hey guys,

i have read trough these treads and from what i could undestand, i don`t need to send the evidence of merging our lifes (joint bank accounts, insurances, joint bills etc.) along with the AOS packet.

But reading the step by step guide for AOS in the pinned thread, the part where they give instructions for the cover letter , it sais

"-form I-485 AND evidence" , i will copy and paste it here.

So do we, or do we not need to send the evidence too?

"Cover Page" Information:

In the checklist above it is recommended that you include a Cover Page with your application. While this is optional, filing a cover page will help the USCIS understand what benefit your are applying for and specifically what items you have included in your package. Again, make sure the cover page includes:

-- the applicants contact information (name, address, phone number)

-- A description of the benefit you are applying for, (Immediate Relative (Spouse) Family Based Adjustment of Status Application)

-- A table of contents listing the major items in your package (i.e. I-485 and evidence, I-765, I-131, etc)

-- A line with the applicants signature and date

You are filing AOS based on marriage, right? You will have to show proof of bona fide marriage and submit documentation of that with the I-485. The instructions for the form have suggestions on what to include, and you can find extensive lists here on VJ as well. Most common are joint bank accounts, joint lease / ownership of a house, joint insurance, phonebills, other utility bills, affidavits from third parties, and photos. This is, of course, in addition to the most important, which is a copy of your marriage certificate.

Hi, yes , adjusting from marriage and i know about proofs of bonafide marriage but most post i read here said they have to be brought at the interwiew, not sent with the AOS pack.

That was my question, send them, or just take them at the interwiew?

K-1s do NOT need to send any evidence in their I-485 packet. Only concurrent filers need to do that (because of the I-130).

In that link which is specific to K-1s, "evidence" may refer to your marriage certificate or something.

Good luck. No need to send proof of bonafide marriage for K-1 AOS. If you have interview, you'll bring it then.

we just sent our marriage certificate (make sure it is a CERTIFIED COPY) not just scan the original!... ... when it comes to Affidavit of support.. INCLUDE evidence of his job.. like employment letter and assets.. we included assets and a bank letter, even tho my fiance met the requirement... :) like harpa said.. k1s dont need to send more evidence

You're right GJen, my original post might be misleading. K-1s do need to send evidence, like marriage cert and stuff for I-864 and copy of K-1 visa and passport, and NOA2 for the I-129F. Just no proof of bona fide marriage is needed, because your relationship was scrutinized at consulate phase. Good luck.

Also, when sending the AOS package make sure that you have the latest forms from USCIS website. I think they just updated I-485 in February. When you print the form, check to see if the bar code on the bottom of each page is printed too.

2-11-11-Day 4 - received text message from USCIS with the receipt number

2-18-2011 - Day 11[/font]- received NOA 1 in mail for I-130, I-485, I-765, I-131

2-22-2011 -Day 15- received biometrics letter -appt March 14

3-10-2011- still cannot see case online although I called USCIS two days ago

3-14-2011- Day 35- Biometrics done on the appointment day

3-24-2011-Day 45-case showing up online!!!! USCIS mailed on 3-23 my interview appt letter- April 26 is the day!

3-26-2011-Day 48-Received interview appt letter

4-1-2011-Day 59- USCIS mailed I-131 approval and ordered production of my new card (I assume the combined EAD/AP)

4-11-2012-Day 69- received EAd&AP combo in mail! Bad picture!

4-26-2011-Day 84-APPROVED!!! Card production ordered!

4-30-2011-Day 88-Welcome to America letter received

5-4-2011-Day 92 - received green card in mail (8 days after the interview) - it is kinda green!!!!

There's an AOS thread in my signature that has the required documents list.

When it talks about "evidence" it basically means evidence supporting your application/eligibility for AOS. In terms of a K1 it's proof that you entered with a K1 visa, then that you married in 90 days, then that your vaccinations are up to date and financial stuff. The only time you'll be sending proof of relationship is:

1. If you have an interview

2. Removal of Conditions

You are filing AOS based on marriage, right? You will have to show proof of bona fide marriage and submit documentation of that with the I-485. we just sent a photocopy of the marriage certificate. not an issue. at the interview the IO asked to see the original. that's it.

Oh wow!that sounds good!:P Some people have been given a few certified copies of the certificate by the judge that married them so hope we will get some too :Pwe`ll ask him!:)
