How can an NVC officer verify a document in a foreign language without an English translation? I'm sending in the translations. The last thing I need is an RFE! :)

Hi Jenny, you are right – according to the State Dept website, you definitely need a certified translation of the civil documents:

EGUZI,

when you call NVC, what do they tell you? did you do anything? and did you get any response from NVC or USCIS? please let us know.

NVC says they have no record of my case, so they always ask me to email a copy of the approved notice and I "Always" tell them I already have, in the end they reply, "well sir there is nothing we can do if we have not received the case from USCIS, which I understand that :). Then I call USCIS, if I get ahold of a lazy agent, they will usually tell me you have to wait till february 26th which is the 90 days period :S, if it happens to be a nice agent they will tell me sir, we have to collect the paperwork from various directories and usually it takes time :(... So basically my case is collectiong dust under a pile of early approved cases :'( ...and the waiting continues

NVC where are you

Ohh, that's a good point. My thinking was that unless you are doing Direct Consular Filing, the "country in which application for a visa is being made" would be the U.S., since you're sending your application to the NVC (although aside from the Affidavit of Support, I guess the NVC is mostly just collecting the documents to send along to the consulate).

Even if it's not necessary though, it seems like the safest thing to do would be to send in translations because maybe the consular officer would want to see them. Again, I don't know what's necessary/best, but that's just what I would do to be on the safe side. Obviously this situation is different, but when I was applying for my Taiwanese passport (which I applied for while here in the States), I had to translate my birth certificate into Chinese.

EGUZI,

from your response, now I am confident that we can not do anything before 90 days. it is going to be another three or four months added to i-130 NOA2 before our case reach nvc. it is so sad that CSC cases only takes 10 days to reach nvc but TSC cases forever. We are now caugth between nvc and uscis and both don't take any responsibility. it means that for long time we have to just call nvc and listen to nvc AVR that we have no record of your case!!!!!

My 90 days will be up on 02/23/2011, but I am hoping every day that I will receive a text or email from USCIS saying that my case has finally been forwarded to NVC. I have had the NVC paperwork prepared for quite some time now. It is inconceivable that USCIS would need to "finish processing" an approved petition.

So there is no need to send in a translation with the birth certificate? I already translated it so I was going to send it attached. I also translated the police certificate. It wouldn't hurt to send in the translations, right?...

They didn't have a problem with the translations at all. The only issue I had was "Original Birth Certificate". I sent a certified copy with the translation the first time. When I got the RFE, I called them and said the NVC already has two copies of translated and certified copies of the Birth Certificate so I'm only gonna send the original one. They said that it was fine as long as the language on the birth certificate is the same as the language spoken. She's from Cambodia and we have our own written script different from English. Send everything translated since you already have it. Less chance you end up with a huge headache like I did. Good Luck.

well I agree it wouldnt hurt to send in translations, but according to the part on translations, they are not needed. The country in which the visa is being made would be the beneficiary's country, not the US.

I wonder if this 90-days business counts towards their "goal" of 5-months processing time. Honestly, it's been 6.5 months for me, and it would probably get to NVC sooner if I refiled at CSC TODAY.
