Hi everyone,

I'm asking on behalf of a friend who.

My friend lives in Jamaica and has been talking to this guy she met online for about a year now. He cannot travel due to child support issues and so they are thinking about doing a fiance visa but they have no pictures together or any form of evidence that they're truly together. They talk on the phone every day and he sends her money which she keeps the recipt for but she's afraid it might be enough so she needs some advice as to what to do. Should she talk the chance with the fiance visa?

One of the requirements for the fiance visa is that the couple has met in person within the last two years.

Either met in person in the past two years or able to show that meeting in person would be an extreme hardship. Though if he has child support issues he may not qualify when they do the background check anyway.

You cant apply for the K-1 unless you have met atleast once in person. So either she forgets about it or he visits her.

Honestly, they will have to meet in person so there is nothing to done until this happens. There is no way around this requirement. He will need to resolve is child support issues if he is truly trying to start a new life with your friend.

Ahh, you're right. There is the technical possibility of waiving that requirement, but as I understood it was normally for religious considerations. Good to point out.

It's very unlikely to be approved without having met the meeting within two years of filing condition. Your friend could potentially attempt to file a waiver on that requirement, but those waivers are also very unlikely to be approved especially if he is unable to travel because of circumstances that are/were under his control.

I'm guessing she isn't likely to be approved for a tourist visa to visit him in the US?

And you may not know and it's probably not my business, but what "child support issues" prevent him from leaving the country, even temporarily? If it's back payments, even if the condition was waived (which, again, is very unlikely) would he be able to meet the requirements of the I-134 Affidavit of Support form? And if he does meet the requirement, why isn't he paying his child support? There are a lot of things for your friend to consider, here, IMO, for her own sake.

Visas are hard to get in Jamaica but she's thinking about trying to get one, as for the child support issues I'm not too sure what but I think it went to court so it's kind of a big deal.

The child support issue effects his right in having a passport. He needs a passport to travel, so since he is behind in CSP, his passport is deemed void. There is NO waiver that he can qualify to over-come this.

No photos or evidence of what? If they had photos and evidenace and they somehow had gotten lost I may understand. But they don't exist and they have no evidence because they've never met. In order to accumulate evidence of a relationship, you have to actually be in a relationship.:blush:

He really needs to pay her a visit and make sure they have the relationship/chemistry you friend seems to think they have. Once he does that, they'll meet the letter of the law in having met in person within the past two years. Exactly what child support issues are preventing him from visiting her? It sounds more like a money issue. If he can't afford to buy a ticket to go visit her, then he probably won't be able to meet the financial support requirements either. Remember, any money that he's paying toward child support goes against his AoS either directly or as an additional dependent for each child he's supporting. They need to look at the reality of their situation and determine if what they want is even possible.

Meet in a country that does not require a passport to travel to, mexico? Think all he needs is his license as long as he is not flying there. Not sure if she would need a visa to go but if she did im sure she could hop the border into mexico somewhere, mexican authorities would nevvvveeer expect that.

Puerto rico? he could then charter a small plane to fly him to jamaica and either attempt a water landing or parachute in, dont ask me how he would get home.

The Cayman islands ( not sure about this one ) but the charter plane would cost less as its a bit closer to jamaica.

or... he could work something out with his childs mother and take care of teh child support thing...
