Just in case CR-1 takes forever......!

Once you enter US on K3, my understanding was you have 2 choices - AOS (adjust status in US) OR stay in the US on K3 + apply for EAD and go back to home country when CR-1 is ready.

OR One could enter on K3 --> apply for EAD as soon as you arrive --> return to home country --> Re-enter on K3+EAD --> Then choose AOS vs go back to home country when CR-1 is ready!!!

Any thoughts from anyone on the last part??? Theoritically, it seems possible.....Realistically, any opinions, experiences or thoughts??? :unsure: Has anyone done this???

People who applied for I-130 followed by I-129F: Please post reasons why you did this???

I've been thru this whole process once before with my first wife. Back then the IR-1/CR-1 process took forever, its a immigrant visa so there is more involved with investigations, everything is done at the NVC, etc etc, so the K-visa's were created to help bring fiancee/spouse/kids to the US faster because the K visa's are technically NON-immigrant visa's. Non-immigrant visa's take less process time because supposively there is less investigation required since it doesn't grant anyone a Permanant residency, plus most of the process happens at the Embassy/Consulate and not at the NVC. K-3 is still offered and its free to apply once you have filed for the immigrant visa so why not? Why not apply? I read some people saying that its a bad idea to send it in or apply for it. Why? I'm puzzled. They say it slows down the whole process. I don't think so, if anything it speeds it up or has no effect. The K-3 is actually a pretty good visa, you can come and go with it just like a greencard, many same benefits, but some problems with it would be for example, if someone on a K-3 visa wanted to get financial aid to go to school, can't get it on a K-3. Need a greencard or citizenship for benefits like that. They say now the IR-1/CR-1 visa is processed much much faster now, same timeframe as a K visa so if you don't apply for a K visa probably isn't a big deal. But what if there is some delay in the CR-1/IR-1 process? It's probably unlikely, but what if?? LOL you never know, read some of the other boards and you will see some people get into some bizzare nightmares because they send in a wrong form/info or some silly mistake. If there is no problem with your CR-1/IR-1 then the K-3 just drops off, its canceled. If for some reason you get caught up in the process like at NVC then your gonna wish you filed the K-3. And if you enter on a K-3 its easy to convert it to a greencard.

In our case, the USCIS told us that 129F will help the I130 get done earlier. Anyhow, we'll see. That's what they told us. And from my friend's case, it was true. It's case to case maybe. :)

Thanks BabaLu. Feel better now. Filed the I-129F yesterday after getting the I-130 NOA1 hardcopy. After doing research, I found that other than the extra effort, NVC fees - there was no downside to applying simultaneously for a K3. Might as well use it while the K3 route is still there for the time being...!

Hey - could you call USCIS back - some experiment?

Day 1 - talk with only Tier 1 Reps, Customer Service Reps - the first human that answers the phone.

Call 10 times over the day, and record yer answers

Day 2 - talk with only Tier 2 Reps, Immigration Service Officers - you must ask for an ISO, each time you get a Human.

Call 10 times over the day, and record yer answers.

Hi Everyone,

I have been here quite a while hoping that it will be over soon. I had my I-130 approved in August but I-485 denied because we failed to submit one single document. The W2 from my joint sponsor. :bonk: Anyhow I have refiled again and hopefully everything will go smoothly this time. :)

today we got our N-797C NOA today, the cheque has been cashed.

it says (preference classification) 201B INA spouse of USC.

i checked the status on the USCIS website and the status is up to 'initial review'

we are both over the moon! :thumbs:

2004 - we met online.

7th May 2007 - filed I-129 paperwork

9th June 2007 - received I-797 notice of action

13th November 2007 - I-129 approved

18th December 2007 Visa and medical interview

12th January 2008- Shipping company arrived

14th January 2008 - landed at Newark Airport.

9th March 2008 - got married(received SSI number)

April 2008 - My things arrived in USA from the UK

9th March 2009 - our 1st Anniversary

14th June 2009 - returned to the UK

9th March 2010 - our 2nd Anniversary - spent apart - so lonely :(

1st September 2010 - filed I-130 (applying for IR1)

11th Sept - Received I-797c address part C error

13th Sept - Resubmitted I-130

24th Sept 2010 received second I-797 NOA status - "initial review"

4th January 2011 - I-130 Approved - moving to NVC!

12th January 2011 - I-130 forwarded to NVC.

31st January 2011 - Notification of LDN number received in the post.

It seems like there is a huge backlog at the California Service Center...they're processing much more slowly than Vermont...anyone heard anything about this? It's depressing.

Also, unrelated--how do you get your timeline to link to your posts? I can't figure it out...thanks.

Don't stress out about it... a couple of years ago it used to take almost triple to process anything...
