Timeline

Yes, we sent in the K3 petition today. I am doing it just incase the cr1 gets delayed for some reason. If it gets delayed, hopefully the K3 will get approved and she can come to the US on that while the CR1 is processed.

I heard that K-3s aren't getting processed any faster than CR-1s...which is why I just decided to go that route and have my husband come in with full permanent resident status.

Dec 7, 2010 - Received text/email NOA2!!

Dec 11, 2010 - Recieved hard copy NOA2

March 10, 2010 - Received notice of interview appointment for April 7th

April 11, 2011 - Went to interview and given paperwork to do medical exam(after he had requested the docs and they wouldn't give them to him)

April 26, 2011 - Rescheduled interview

April 28, 2011 - Visa approved!!!

August 7, 2012 - NOA1 received

January 23, 2013 - Email/text notification of approval

Got NOA1 today...in 10 days! Have to be realistic about the next step, though. They seem really backed up at the California Service Center.

Any thoughts on the following as a means of getting spouse to US as soon as possible & be able to work (while CR-1 pending):

K3/129F route as plan B (after getting I-130 NOA1). Just in case IR-1/CR-1 takes forever......!

Then K3 --> POE --> EAD Apply after POE (No AOS/I-485) --> Back to home country after applying EAD --> Re-enter on K3 + EAD or IR-1/CR-1 (whichever one comes earlier).....!

Meanwhile if IR-1/CR-1 comes through - good.

Caviat: NVC cancels K3 application if IR-1/CR-1 comes through earlier.

What do you think??? Any risks or disadvantages with this method (other than cost & effort)? :unsure:

Hi there, I talked to three different lawyers about this before deciding to go the CR-1 route and not do a K3; they all said that there is now NO time difference between the K3 and CR-1. The K3 will cost you more money and then your spouse will come into the US and have to adjust status afterwards.

I really wish there was a faster way to do this myself...but it doesn't look like there is. That's just what I've heard based on my research.

Just in case CR-1 takes forever......!

Once you enter US on K3, my understanding was you have 2 choices - AOS (adjust status in US) OR stay in the US on K3 + apply for EAD and go back to home country when CR-1 is ready.

OR One could enter on K3 --> apply for EAD as soon as you arrive --> return to home country --> Re-enter on K3+EAD --> Then choose AOS vs go back to home country when CR-1 is ready!!!

Any thoughts from anyone on the last part??? Theoritically, it seems possible.....Realistically, any opinions, experiences or thoughts??? :unsure: Has anyone done this???

People who applied for I-130 followed by I-129F: Please post reasons why you did this???

It seems like there is a huge backlog at the California Service Center...they're processing much more slowly than Vermont...anyone heard anything about this? It's depressing.

Also, unrelated--how do you get your timeline to link to your posts? I can't figure it out...thanks.

In our case, the USCIS told us that 129F will help the I130 get done earlier. Anyhow, we'll see. That's what they told us. And from my friend's case, it was true. It's case to case maybe. :)
