Could abuse of USCIS customer care representatives cause denial of AOS?

My wife called the USCIS to know about the updates of our case.We filed our AOS and haven't received our biometrics letter.The representative at USCIS was reading off the computer and was very aggresive with my wife, and after some time my wife just lost her temper and started calling the representative F!@#$$ W!^@%#$# and all the mean names which was very stupid of her .

Now, I really don't know what to do,should I call them and say sorry or what exactly could be done in this regard? Is there anything like abuse of customer care representatives? Could they deny our case because of my wife calling the USCIS rep dirty names?

While I think what your wife did was foolish, I don't think it will cause a denail. Calling USCIS is useless, all they can do is read exactly the same thing you can read off of the USCIS website. It is a large call center, calling back to apologize would be useless because there is no guarentee you'll get the same worker or the same location.

I'm not sure if they can deny you for that, but it is always recommended that you are nice to people. Especially if they have the power to approve or deny your case. Wish you luck.

The process can be very frustrating and often calling NVC leaves one feeling less than fulfilled. But these NVC contractors are trying to do a job and while they may or may not be helpful, none of them should be abused. It's unlikely that this will hurt your petition but for your wife to jump on the person and start with the profanity and turning it into a personal attack is terribly inappropriate. It's one thing to be angry and another to start calling the person a F this and W that....man. I would suggest your wife not speak with them if she can't manage her emotions even if she is up against some frustrating NVC person. But it's not worth losing your cool especially if it can happen more than once.

I highly doubt it will affect your case, but it would probably be good for your wife to get her emotions in order come interview time. ;)

This is a long process and it can be difficult. Don't let it tear you apart.

It would only be rational for someone to assume that you pay all that money for your AOS package, you get treated rudely by the customer services staff at USCIS. Imagine buying a $1075 dress at a retail store and you get treated like that?

I dont think such a confrontation would affect your greencard chances, but next time be careful...esp at the interview.

Car insurance Co's are notorious for making note of "irritable or agitated" customers when calling the service rep. I hope USCIS does not tell its reps to add notes about customers calling in. Just have wifey B-R-E-A-T-H-E the next time she calls the less-than-helpful USCIS Rep.

The way I see it is like you are calling a credit card company ,if you call the representative names your debit is not gonna go higher right?

Call USCIS will not help in most of the times they are there just for information and in most of the time just read what is on the website if you want to do something about your case make an infopass and please don't call the IO names than you are going to be in a lot of truble ;)

If your wife just used bad words she was probably slow tracked. If she threatened the person she could be arrested and charged with a federal crime and that would affect her progress. Federal employees are supposed to report threats against them and they are supposed to be handled as terrorist threats. So hopefully she just used bad language.

This will not be over quickly. You will not enjoy this.

No problem. I had a heated verbal exchange at an infopass appointment when we were over the processing time frame....the idiot tried to tell me ALL green cards take 18 to 24 months to process and I called him out on it. He asked me if I thought I knew more about immigration than him, and it escalated from there. He was very rude and I gave it right back to him and then some. About two weeks later we had our interview and passed easily.

I doubt at this point it could cause denial. I just don't see a customer care rep having any ability to do so. They have minimal access to your case file. Even if they can make a note in your file, I'm not sure how that could be grounds for denial. Unless there was an actual threat involved or something.

Now, if something like this were to happen at the AOS interview it could cause denial. They could easily just have security remove the abusive person and end the interview.

This only helps with 20-20 hindsight, as others have said, but she should have known that

the representatives she was talking to on the phone do not have the power to approve,

deny or even enquire into the status of a case, hence their reading from an online script.

If she signs up for an infopass they will be able to punch up your case right in front of her

and tell her what the status is. At that point she might apologize for the poor choice of

words that may very well have been recorded. If they weren't recorded, she is still showing

class by apologizing. The infopass interview is always conducted by an Immigration Officer,

so she should be on her best behavior. :yes:

Hi Mike,

I am sorry that you have this added stress in your life. In your wife's defense, I made that same phone call last week for my husband as we hadn't received his bio appt. letter and it had been over 6 weeks. It was frustrating watching all the other june filers on that thread already getting EAD's approved, interview appointments etc... and he still didn't even have a bio appt.

That phone call was the most ridiculious waste of tax payer money. When I first got on the phone with the rep, I told her exactly what I was calling. Then she went into this incredible script, are you a Haitian refugee, are you a naturalized citizen, etc..... and on and on. I said nicely, look I already told you I am a US citizen just calling to find out if my husbands bio appt was sent in the mail, and we didn't receive it or if it hasn't been sent yet. She said I have to go through all these questions, so I just shut up and let her ask. I tried to make her laugh and it was like talking to a wall. These questions went on for over 10 mins.

Then she had to have my husband verify that I was allowed to speak for him. Then she said, o.k. you can speak for him since you are his translater. He's Australian! So I finally got her to laugh saying my accent was easier to understand.

After that, she said that it had to be 30 days from the day I received the NOA's in the mail before she could make a service request. So I verified that I received the NOA's exactly 30 days ago and she said o.k. she can put in a service request. Then I asked her what to do if we still did not receive the letter and she said I needed to wait 30 days before calling again. Then I thanked her profusely and said her job must be very hard because she is forced to read through that whole silly script and people must get frustated. She agreed.

His biometrics appt. letter was printed and mailed the next day, so the saying "you catch more flies with honey" worked in this case for me. Did your wife get to the point where they made a service request for her? If they did, she would have been given a long confirmation number. If she didn't get this, she needs to call back. If she can't control her temper, then you should call for her and be her "translater." Just shut up and listen to them go through the silly questions, be very friendly, have her there to confirm you can talk for her and get the service request in. As I said, our letter was made and mailed that day after that. You might also start the call by saying your wife called yesterday, was sick, pmsing (if you get a guy :whistle: ) and was very rude to the last rep and appologize.

If I was one of those reps who had to read through that script everyday and listen to the justified frustration of the callers, I would be more apt to help the ones who were kind to me and more likely to misplace the request if they were not. Just human nature.

I don't think it will affect in any way the process of your AOS, however, talk to her and tell her to have more patience next time. I know it is frustrating especially if they make us wait and not give a definite answer to our queries, but it's not a reason for us to call them names.

Thank you, all for being so helpful.We had a conversation about that and I told her that she can't do this to people.USCIS people try to help and quite often they are not helpful but this doesn't mean that you could say anything to them and abuse them.Hopefully,this wouldn't cause any prob in our AOS.Sorry for replying late.Thanks again folks...
