Hi everybody!!!!

I just received in the mail my 10 years Green card....thats the good news!!! The bad news is that the card put my sex as M (male) and I am F (female). I just called the 800 number......customer service and they said I had to fill out an I90 form and prove my sex. I asked what i shpuld use to prove my gender and they did not give me a concrete example. The person that i spoke to also told me that i need to prove that the error was an administartive error....because if I am responsible for the error i have to pay $370.00. My expired green card definately says i am a F (female). I am sure I filled out the form correctly. The person that i spoke to also told me that the process could take as long as 6 months.!!!!!!!!! can you belive that?????????????...i am so sad!!!!!!!!!!!......Does anyone have ideas that could help my situation...ie what documents to use to prove my gender? A way that wont take 6 months? Similar situations? Thanks for your help!.

Send a photo showing the appropriate body parts?

Seriously, maybe a copy of the old green card which shows you as female, driver's license, maybe a bill for a pap smear or mammogram? Do you have a copy of your application that you could copy and send with your proof to show it was their error?

For me it would not be a big deal, obviously I am female and I don't need a government ID to prove my sex.

WOW. USCIS fail. :wacko: I'm so sorry you have to endure this. I cannot imagine that you have to pay for *their mistake. I'm so sorry for this! Proof I can think of:

1. birth certificate;

2. passport ident page;

3. conditional greencard;

4. marriage certificate; and

5. photos.

Congrats on your approval, though!

Your birth certificate and previous green card should work. The previous green card would show that they got it right the first time and THEY screwed up the second time.

WOW. USCIS fail. :wacko: I'm so sorry you have to endure this. I cannot imagine that you have to pay for *their mistake. I'm so sorry for this! Proof I can think of:

Congrats on your approval, though!

Concentrate on good news and rejoice that this is a minor issue. If you like take a info pass and get a stamp on your passport.

latoslatos has listed appropriate documents, I would only add one more and that is a copy of I751 form submitted. To prove to CIS that they need to bring their house in order.

That is just awful, I am so sorry!

But yeah.. all the other evidence everyone's mentioned above should work for proof of gender.

Maybe try to make an infopass and bring your expired GC plus other evidence (such as yourself)?

I would personally never rely on information the 800 number people give..

I think your Marriage Certificate, Birth Certificate and a copy of your Conditional Green Card should be more than enough to prove an error on their part. Be happy you received your card. Now with most of the burden off your chest, such minor obstacles would be easy to handle. Let it take a year. Why do you care.

What burns the buns is that the beneficiary has to *pay for their mistake? Egads. Something not very fair about that scenario. :blink:

Thanks to all of you for your suggestions.., after reading and all your suggestions, i will send

1. a copy of my front page passport( shows my gender),

2. My Birth certificate is in Spanish (Somebody knows where to bring it to be traslate to the English Language?...They want an Official traslation)...

3. Copy of my expired Green Card

4. Copy of my daughter birth certicate where show that i am the mother

5. Copy of my marriage certicate

6. Some pictures

7. a doctor's note when he say thta i am a female

8. What do you guys think about a copy of my Driver License?

will this situation is going to affect my term to apply for my naturalization? I called again and they said that probably i am going to need a new Biometric test, and can take the process between 5 to 6 months.

i checked to my I-751 and they don't ask about my gender (like Hondo1z said)

Extra steps: Turns out in Juarez they do not tell you the final result of interview on the spot, you have to wait to receive a DHL package that contains the verdict and passport hopefully. Even though my husband was "approved" during interview (per consul answer) he was placed in Administrative Review on JUly 6 according to consulate operator.

Placed on AR post interview:07/06/2010

Picked up Blue slip AR (they kept his passport):7/09/2010

Visa issued: 09/15/2010

I was in AP for 2 months, 2 weeks and 2 days

Completed my journey in 10 months, 2 weeks and 2 days

contact the Ombudsman an you see how fast you get back your green card with everything correct on it.. bc that is BS for you to pay so much money for a mistake not on ur side..

Actually, that's a very good suggestion that I hadn't thought of. I would do that as well.
