You may know that, and perhaps others, but until USCIS decides (as in adjudicates the VAWA petitoin) that Shona's husband abused her, as crazy as it might appear, those are the regulations. The simple answer is that Shona's case was marriage-based, and the marriage failed and without attendance at an AOS interview, the application was denied. I'd think that chances are, with another petition pending (VAWA), there will be a stay of removal anyway.

Thanks everyone for your good wishes. I really appreciate it :D

I got back from Detroit several hours ago- with a smile on my face. I went into court (a small room) conceded the charges of my overstay. and asked for relief in the form of my petition to carry on being adjudicated. The judge was lovely and joked around when she asked if I could understand and speak English. I was in there only 10 mins!!!!In a nutshell she said I could carry on the petition and would need to come back in April 2007. In the meantime if my petition is approved then I go into deferred action (won't be removed) I can then file my AOS with the court , hopefully sooner than next April and the case should be dismissed.

I'm totally relieved and thankful that at least I can have my case heard.
