Hi there,

I'd love it if anyone had some helpful insight on this situation.

We filled for my A.O.S last year... i am an Irish Citizen who married my wife on an R-1 Visa.

We had our initial interview and they thought all was well, it went well enough but said they had to work out our file with another one of the same name..... anyways.... they said we'll have your decision in 3 weeks or so.

"Or so" must have meant "over a year" as it will be 1 year exactly next week.

Well to the topic.... we just received the exact same letter we got last year... it even says "initial interview" on it. It was addressed to me (the non USC) i hear that matters as to wether it's "Stokes" or not.

We recently moved to a new State.... did they just start the whole process over? We did go for the infopass earlier this year and they said our case was being looked at and was going well..... This whole deal is really mentally draining.

Anyways does anyone have an idea as to weather this is officially the "Stokes" or not.... it doesn't say Stokes anywhere on the letter. Other than the address everything is the same.

Thanks for your time

No idea, but it may just be that since the first interview was a year ago they are just ensuring that nothing has changed in your relationship since the first interview. Why they don't just give you the AOS, I have no idea. If you have a valid relationship even if it is a stokes interview you should be fine. Good luck.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Thanks.... yeah, I'm at this point, indifferent as to whether we pass or fail... wherever we go we go together. I do hope the humor is not lost on whichever gov official deals with us.

If it's to be a Stokes interview, it's inconceivable that they would tell you that it's a Stokes in advance.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Norm is that stokes interview letter is addressed to the petitioner. Since the letter is addressed to the beneficiary, I would say it is just a follow up interview. Just my 2 cents.

Expect the best, but prepare for the worst... just in case. I apologize for perhaps seeming overly pessimistic, but it's better to be safe than sorry.

I appreciate the input, i wasn't sure if there was such a thing as a simple follow up. I was wondering if the second interview was always stokes. But yeah, doesn't hurt to go prepared.

I never been to that situation but I don't think you have to worry about it unless there's something u know we don't know about it ...just get prepare get all the docs U had on your first interview plus more ...Hopeful U still have everything from your first interview....

Good luck on your interview....

I could of sworn I saw someone posted a letter that told them to go to the "Stokes/Immigration" room for an interview.

Pretty clear on that one what might happen :)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS
