Hi there, a happily married K1 couple here, getting ready to file the AOS. Are we supposed to send the relationship evidence when we file the I-485? I assumed we were supposed to, but now when I start gathering the info I see nothing about it. I do know we need relationship evidence at the interview, yes, but do we send it when we file for AOS in the first place?

Especially interested in any UK couples who have done this recently as I know they're trending toward not having interviews at all as of late. Honestly...how would USCIS be comfortable skipping the interview unless they had relationship evidence for the couple? This suggests they had it already?

I'm so confused by all of this.

Thanks!

Madly and wildly in love

Well, actually, when you think about the variety of people filing for adjustment of status, and many of them never having applied for any visas so far, yes, it makes a lot of sense that K visas would have an easy time through AOS. The embassy was already supposed to satisfy themselves that you had a bonafide relationship, at most 9 months before filing (ideally), and perhaps as little as just a few weeks before filing, so what new information would there be?

You can find other UKers going through the AOS process as well and have their own thread.

I haven't done AOS yet, but my thoughts to you is to follow the guides closely, they have been tested and lead to many successes.

I sent some but not as much as the K1 requires. Wedding pics, congratulations cards, and then of course very well put together documents as far as the affidavit goes and marriage certificate and such.

What you'll be doing is starting gathering evidence of your life together now for the Removal of Conditions two years from when you receive your conditional card. During Removal you'll have to prove the ongoing married life and that you commingle your life, assets, etc.

The above advice is very sensible. In our AOS package, I included a copy of an auto-insurance slip with our names on it, and a deposit slip from our bank with a true note of "this took an act of Congress to achieve." Who knows whether it helped? It didn't hurt, because we had no AOS interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The only evidence we sent with the AOS package was a copy of a bank statement showing both our names on the

account showing mingling of monies. As we were filing concurrently we saved all the main evidence (pictures etc) for the interview.

It all seemed to be fine as we didnt get any RFE's during the process & the interview was fine : )

We only sent the required AOS/EAD/AP forms and supporting documents. We sent no relationship evidence or photos. We married five days after he entered the US and sent AOS four days after that. There wasn't anything we had jointly to send except the marriage certificate. We were approved with no interview.

I go along with Nik and Heather's statement that USCIS knows K1 approval means relationship evidence was already deemed acceptable and an interview was recently conducted with questions about the relationship.

All we sent were the forms and marriage certificate. I assumed pictures, utility bills and other evidence would be asked for at our interview, but we were never interviewed. I got my greencard about three months after we sent in our application.
