Consulate requiring guarantee money?

Find out if she went to the consulate or the embassy.

US Ankara Consulate is what she said, and probably was whatever was listed on the paperwork which is the Embassy. I won't talk with her again until later this afternoon. She is working and probably crying at the same time.

There is nothing I can do about it now. I gave her everything I had and she is supposed to take care of the stuff she needs per the documentation on the Embassy website. She just needs to submit it and get an interview date.

Ok - like I said, Umit and I just sent them our package, and they did not require any deposit on record (K-1). I would be very surprised if they asked for that for your K-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Right, it's not a bribe. It's either a misunderstanding or the "bride" is shaking down the groom. Most likely just a misunderstanding. Ask the wrong question and you get the wrong answer.

When I received my 1st letter from Emassy for K3 it says on the DS-2000 (Evidence which may be presented to meet the public charge provisions of the law.

In the section about Affidavit of support -

6. An expression of willingness to deposit a bond, if necessary, with the immigration and naturalization service to guarantee that the applicant will not become a public charge.

Putting $5k into a foriegn bank account is not considered a "bond" with the USCIS.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

DS-2000 is not required by the Turkish consulate. Only the I-134 and I have sufficient information to guarantee that the applicant will not become a public charge. Nothing else on the instructions talk about money except for the $131 processing fee (per person). So since she has a child she will need to deposit $262 into the consulate bank before the interview.

The only thing that this could possibly be is a mis-understanding.

If you send $5,000 to you fiance you are a making a major mistake.

Either:

Misunderstand on her part

Shakedown on her part

Or her family/ boyfriend/ husband is coaching her

Sorry but this sounds like a scam.

A friend of mine had her interview a few weeks ago and she didn't need any of that (apart from the Affidavit from the USC). It wasn't a consulate in Turkey but still, it doesn't sound right.

K-1 TIMELINE:

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics

We can NOT immediately assume his SO is scamming him. It could be a simple misunderstanding from the CO to her or from her to him. Once he has a chance to clarify things with her, I'm sure he is quite capable a figuring things out. Not everyone is here to pull a scam on a USC.

Some of you are way out of line. A scammer wouldn't have given as much personal information as I have on her including bank account information especially for only $5,000. A scammer wants to get in and out as quick as possible, take as much money as possible, and leave no trace of who they are. Large scams in excess of $100,000 might have fake IDs, housing, and bank accounts involved, but all of that costs money to setup. Someone like that would loose money trying to scam $5,000 if they did all that prep work.

This is definitly a case of mis-understanding by the consulate and my fiancee. That is exactly why I first posted here and double checked my other sources to find out why the consulate would have told her that. The consulate was right on what they requested if you were getting a different visa, but for a K1/K3 it isn't neccisary. It is possible that she went to the consulate without an appointment and ended up talking to someone who's whole purpose was to deter people from filing a visa. This would be a simple way to do it.
