1. have him get a documented explanation as to why he cannot come see ya (i.e. doctor's note if he cannot fly).

2. try to get a tourist visa, and if u are denied, u have a proof that u cannot go see him either.

A lawyer can find the backdoors for this, but u have to have REAL reasons! :yes:

But my personal opinion (even though I wasn't asked) is that it is not wise to go there to marry him, and ALSO take your kids with ya. Try to look at the not so bright side: what if everything you know about this guy turns out to be a huge lie? :bonk:

Me and my fiance has not met yet in person for he wasnt able to visit me yet due to a very reasonable reason,however he wants to get me and my children to come to US.as we read in fiance visa we need to meet first in person.there fore in our case that we havent met what do u think is the appropriate visa for him to apply so he can get us?

As posted on an immigration law firm website :

There is a provision in the law that may exempt the petitioner from the meeting requirement "if it is established that compliance would result in extreme hardship to the petitioner or that compliance would violate strict and long-established customs of the K-1 beneficiary's foreign culture or social practice, as where marriages are traditionally arranged by the parents of the contracting parties and the prospective bride and groom are prohibited from meeting subsequent to the arrangement and prior to the wedding day." INA § 214.2(k)(2). Unfortunately, such waivers are very rarely granted by the USCIS. The "extreme hardship" exception has been interpreted by the USCIS to mean something very close to "impossible". It generally is available only to people who are so disabled that they can't fly at all. As for the second grounds for a waiver, very few people qualify for this exception, and those that do often have a difficult time proving it to the government's satisfaction.

You don't need to post the reason here as to why he cant visit you, but if you both are not Hindu undergoing an arranged marriage, or he is not bed ridden then it most likely wont happen.

Ummm you cant seriously be contemplating moving to another country, marrying a man you never met with kids in tow ....

How do you know he will be a good father figure for your kids? or that he wont beat them up or send them packing of to a boarding school ... or worse.

Its risky enough doing it on your own let alone with innocent children... what about their father? I cant imagine he would sign paperwork to allow you to do this blindly, I certainly wouldn't....

There are a couple of posts recommending tourist visa. This is ok if it is meant to visit the other person, but it is not a good idea to use if planning on getting married during the stay.

12-17-07 Received NOA1

01-06-08 Got engaged!!!

02-27-08 NVC processed petition

Its risky enough doing it on your own let alone with innocent children... what about their father? I cant imagine he would sign paperwork to allow you to do this blindly, I certainly wouldn't....

I would suggest that you meet also. Even if they do grant the exception, I suspect that they will take more time on your case and you might be in AP longer than you would if you meet and can provide more proof of your relationship. Of course we don't know the reasons involved here, but it does raise red flags-especially since children are involved.....

Personally, I couldn't even imagine marrying someone I hadn't met... no matter what the reason.

You can't really know someone until you have spent time with them, interacting with each other, and interacting with any children involved.

The green card, the idea of being in love, the idea of security... None of these reasons are good enought to bring your kids into a situation that you haven't fully examined. You should work out a trip for one of you to go meet the other. There really is no other way. The extreme hardship options are a slim chance.
