I made a suggestion, I didn't tell her, I could have suggested she jump off a cliff to get out of work for a month...I doubt she would have done it...mind you, it would probably do the trick. Get off your high horse.

LOLOL Are you flipping serious?!?!?!

Just. Plain. Wrong.

Yeah, you made a suggestion alright, a suggestion to LIE. Smooth move.

You don't learn do you??? Falsely claiming(and getting a doctor to agree with you) that one is physically and/or emotionally impaired in order to claim extended medical leave benefits such as FMLA constitutes FRAUD. As L&N aptly stated above, just.plain.wrong.

take leave without pay.

Some employers are encouraging that now. We have that option here and a few have done just that.

In some situations that is the most appropriate, but does not work for all. In my job for example, they would not approve LWOP for too long because there is nobody else in my dept. that does what I do....and what I do is in regular, high demand. So the employer would def need a replacement if I'm gone too long. A month is the longest I've been gone, and that was during the slower [for us anyways] month of December.

if they know of your fiance, anything you come up with; they'll know its a farse

+1

Tell your boss the truth and ask him how you can work together to accomodate your plans. I would hate to lie to my boss and then come back to find he fired me for lying. Especially in an economy that is sadly lacking in other jobs to go to.

Good luck and let us know how it turns out.

I love the way things snowball on here!

For the record, I NEVER said nor implied she should claim benefits and commit fraud! You are being ridiculous and have been carried away with yourself! My comments have always been made form a UK perspective, referring back to one of your previous comments about me qualifying a statement, this I have never tried to hide, one only needs to look to the left to see where I am from and still live.

Anxiety manifests itself in many different ways, and alot of people suffer from it. If this person is suffering from this process and being seperated from their loved one for a prolonged period, which they have implied from their original post, then anxiety is something they may wish to discuss with their Dr. The visa process has caused me some anxiety and no doubt many others before me. This person has made a request for help, a genuine request, to see their loved one after 6/7 months apart. I feel for this person. I believe that life comes before work, an ethos that may not be familiar to those working in America right now perhaps, but we have laws in place here to help sustain a 'work/life' balance. Here, if your personal life is suffering and you put you case to your employer, they have a moral and legal duty to listen to you and if possible make changes to your working life in order to support you. If your employer chooses to ignore these pleas or is unable to help, some people find themselves in an unfortunate position where they may need to make decisions that are not favourable.

I would ask you kindly to stop fueling this ridiculous thread by painting me as some kind of crook looking to encourage fraud. Read things more carefully and don't jump to conclusions.

I have read on other sites where some guys enjoy logging onto sites (anonymously) like this one and getting people "riled up" for fun. Since I don't see any other replies by this original poster in this line, that might be the case. Some people are just bored and don't have anything else to do but get people spun up.

The reply to the question was obviouis, I suggest removing this string from the list.

Please do not recommend abusing the FMLA! This is NOT covered under the legislation so it does not qualify anyway.

Ask for unpaid leave and hope for the best. and like others said, hold on to that job --- you will need it when fiancee comes over. Family is first and all that jazz; but why jeopardize your livelihood and hence their needs?

Totally agree with Len, especially the bolded. FMLA is not in place to use for trips to see loved ones!

Anxiety. Theres no way they can prove aren't suffering from it as long as you can get a Dr to write a note. My Dr would be sympathetic and do it ;)

#######? STOP ADVOCATING FRAUD. Seriously, VJ is not a place where we advise people to lie their way through things. I find it disgusting that people abuse laws like the FMLA based on bogus claims like this one. The OP needs to grow up an face the music.

Well, now, hold on a second. I suggested being very honest which is what I did "I am going and if you don't like it stuff it!" Though I said so in a more polite, but no less assertive, manner. I only suggested checking on the FMLA, I do not even know if it applies for for foreign marriages and don't care because I don't need the government to protect my back. But you didn't seem to like my suggestion either, as it may put the OPs job at risk. And in fact your posts seem to be attacking whatever suggestion is presented. So what, exactly, IS your suggestion?

Grow up and face the music? I suggested exactly that.

Protect your income? By what, lying? And 'round and 'round we go.

I did not jeapordize my income because they need me at work and though they may not like that I take some time off for my family, I do not really care. If they would fire me, they would have done it long before now. But since I am very valuble to the company and can live without the income of some days of unpaid leave, that is what I do. If one's job is so delicate as to be in jeapordy for caring for the needs of your family, you better be looking for a new gig now, because the reality of bringing a foreign fiancee and all the time need for adjustment will torpedo your career if it is that delicate.

If you cannot afford a few missed days pay, you are going to have a really tough time in the real world. All that 125% of poverty level stuff is just as useless as the USCIS timelines, you need, minimum, 400% of poverty guideleines to support a family, for real.

So I agree with your last post (I think)...Grow up and face the music, tell your employer the truth. Do not "ask" for time off. TELL them when you are going and for what reason and when you will be back.

VERMONT! I Reject Your Reality...and Substitute My Own!

Getting out of work and the K1 process are two seperate things. People go off sick all the time.

Being sick is a legitimate excuse for perhaps not going in to work. FMLA is not approved for your common cold...it is for documented long-term illnesses anyways, but others' abuse of the system doesn't give anyone else the green light to do an end-run around the system because he hasn't seen his fiancee in 6 months.

-P

Like I said, no idea what this FMLA business is, in the UK you are allowed time off work for family issues without having to go to the lengths of needing to dream up excuses. The end.

Start learning then - you are moving to the US, better know the laws. And stop telling people to lie. The end.

to *len*: i like ur bluntness....no pretense, just the truth of the matter.
