This may be a few years out of date . . . we included letters of intent with our initial petition and I was later specifically asked for the letter of intent at my interview. We had prepared a new one - so they may approve the NOA2 without it, but it will be expected later on.

Well it is stated on the VJ "Guides" that it is needed to file for a K-1

5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)

You are asked for one with the initial petition and then again at the interview with an updated date to prove that this is still your intention.

Because some of you got approved without it only means that you were lucky.

I'd be pretty upset with a lawyer who didn't know enough to send it.

Why risk a delay in your processing when you can take a few days now to get it right?

my opinion is that a letter of intent helps with the petition as it clearly states the intention of the two... and that is why the VJ guides are recommending it... but i don't think it's a necessary document...more like an evidence.... Am i right?

i know the embassy requires you to sign something like that at the interview...but i hope this won't affect the processing of the petition.

Does anyone know if the letter of intent is needed at Brazilian consulate? I jsut sent my I-134 but forgot to include a letter stating it was still my intent to marry her.

If they did not request it in the information packet sent to your fiancee then it is not required.

They didn't request it per se, but included a form for her that she would have to sign stating her intention not to marry before she arrives in the U.S.

Section 7 B of the I-129F instructions states:

Provide original statements from you and yourfiancé(e) whom you plan to marry within 90 days of hisor her admission, and copies of any evidence you wishto submit to establish your mutual intent; and

It's a requirement but obviously many have managed without them. I wouldn't advise trying to do without them.

Facts are cheap...knowing how to use them is precious...

A word of advice...include it if it's required...and rfe at csc can delay your case by a month!

Well, the letter of intent is probably the EASIEST part of the entire K1 process :lol:, so send it in with the K1.

If you get past the USCIS without it, they may ask for it at the actual interview. If that is the case, you can write one out by hand and sign it right there at the interview if needed :yes: Its that simple :yes:
