    An Affidavit is a legal document in which someone makes an oath. http://en.wikipedia.org/wiki/Affidavit


    It it a common part of evidence to supply proving a bona fide relationship / marriage. In most cases it will need to be signed by the person making the oath in front of a Notary.

    Below you will find a template for an affidavit attesting to the bona fide nature of a relationship, there is one for the USC spouse, and one for a third party.

     

    It is not always necessary to supply Affidavits with your I-129F/I-130 Petition, but it can be a common request in an RFE.

    Spousal Affidavit

    In re application for a Visa for the United States of America Evidence in support of a bona fide marriage between [NAME] Applicant, and [NAME], Beneficiary

     

    AFFIRMATION OF [NAME]

     

    [NAME], being duly sworn, deposes and says:


    1. I am making this affirmation in connection with the application of my wife, [NAME], for a Visa for the United States of America. The contents of the affirmation are based on my own knowledge and are true.

    2. I was born on [DATE] in [CITY, STATE].

    3. My present address is [FULL ADDRESS].

    4. I am the husband of [NAME].

    5. I am a United States Citizen and I have submitted an I-130 petition for my spouse, [NAME], in order to obtain Legal Permanent Resident status.

    6. In chronological order, the details of our marriage are as follows:

    [HOW WE MET]

    [HOW OUR RELATIONSHIP DEVELOPED]

    [HOW WE DECIDED TO GET MARRIED]

    7. Our marriage is a bona fide marriage, and neither [NAME] nor I entered into it for any immigration-related purpose.

    Third Party Affidavit

    4. [NAME], the beneficiary, is my daughter.

    5. [WHEN THRID PARTY FIRST MET / BECAMAE AWARE OF RELATIONSHIP OF PETITIONER AND BENEFICARY]

    6. [OTHER OCCASIONS THRID PARTY HAS WITNESSED FIRST HAND, WHICH CONFIRMS THE RELATIONSHIP IS GENUINE]

    7. I have visited [NAMES] in their home in [PLACE], and found them a very happy couple and obviously in love.

    8. I was a witness at [NAMES]wedding on [DATE].

    9. I have personal knowledge of the bona fide of [NAMES] relationship. Their marriage is legitimate, viable, and not entered into for any immigration-related purpose.
