    I-134 Affidavit of Support

    This form arrives as part of packet 3 for K-1 Visa petitioners (after NOA2 but before the interview.)

    This form is used to show that the USC can support the foreign fiance and that the foreign fiance will not become a public charge. During AOS this process is done more thoroughly through the I-864, as such, the requirements and supporting evidence is very similar.

     

    Evidence For Employees

    For 'typically' employed persons, the evidence is relatively easy- copies of pay stubs, letters from employers etc (see the form instructions here).

     

    Evidence for Self Employed

    Self Employed people proof seems to be more stressful. There is much discussion in the forums which is hopefully summarized here. For example, whether IRS Form 1040 line 22 or 37 is used as income level, it seems that 37 is the line used. Because tax law can be generous to small businesses, this number can be much less than real income, so provide business statements and savings and assets statements.

    TAX RETURNS For proof of income, you can submit copies of tax returns along with paychecks and contracts. It is better to submit IRS Transcripts! You can do this by calling or submitting a form to the IRS, and they can mail or fax them to you. The easiest and fastest method seems to be to call and request the transcripts be faxed to you. In some offices you can go in person and have a transcript printed for you on the spot. Just remember going to the IRS is like going to the DMV. Check the IRS webpage for your local office then click "services offered" to see if copies of transcripts is offered. They are typically mailed in 1-2 weeks or faxed within a day.

    Definitely get letters of employment for any regular clients, provide business financial statements as well as savings and assets if you are at all concerned with the amount of income you are showing.
