My Form i-130 at NVC taking too long 2018

Hello guys,

 

It's my first topic here, if I wrong please some moderator could move this topic to the right area.

 

I married on April 16, 2017 in the U.S and my lawyer applied my petition on April 26 when I returned to my country.

My process has been approved and they send to the Department of State on Jan 17, 2018 but until today they didn't send any message about my process.

Is It normal this all time take too long for this process?

Should I call to the USCIS?

Not entirely sure....did you came on a K1? Anyways, you can always call USCIS with your case number and request an status. Are you currently waiting for the AOS?

8/14/17 --- AOS sent I-485, I-765, I-131

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

If anything, you should call the NVC (1-603-334-0700) and ask if they received your file and whether they have already generated a case number for you. Have your USCIS receipt number ready when you call.

Are you a USC or an LPR (green card holder)? If it is the latter, then the I-130 will sit at NVC until the PD is current before they will process it (although you can submit some paperwork a little sooner based on the visa bulletin's filing chart).

No, i didn't T_P. I entered with B1/B2 Visa. In respect of the AOS, i don't know what it is that mean for me. I just received on website page this message:

 

"On January 17, 2018, we sent your case, Receipt Number _______, to the Department of State for visa processing. You can find general information on Consular Processing by visiting our website at www.uscis.gov . The website will provide information on what to do next, who to contact, and how to inform us of any changes in your situation or address."

It does take some time for a case to be sent from USCIS to NVC, but it is weird that you haven't heard anything since January. The good thing is that the USCIS status you posted means that they actually sent it off! You should have been bugging NVC for your case number for the past three months already!

Anyone of those. the laywer that I contracted dind't say anything about that. She just told me that I will wait for some months to make an interview after this message ( "After this message, the consular will send to you another letter about the NVC and after that they'll call you to make an appointment). Me and my housband are already worried about it.

Is your husband a US citizen or a GC holder? If he is a US citizen, he and/or you should have already received an email from NVC to start the next process. If he is a green card holder, you will need to wait another 1 - 1.5 year.

 

Call NVC and ask for the case number.

Oh dear. She doesn't sound very helpful. When has she last updated you on your case?

If your petition for a spousal visa was approved by USCIS, they send it to NVC, and as soon as NVC has scanned your case into their system, they will need additional documents from you – as long as you don't provide these, nothing's gonna happen at all. Do you know if you lawyer provided NVC with more financial and civic documents? Or are you skipping the NVC step entirely?

 

I'd suggest you call the NVC and let them tell you where your case is at, and then get in touch with the lawyer immediately demanding a case update.

Her uscis case number shows that Nebraska processed her petition and sent it to NVC for further processing
