Visa denied

You have no marriage relationship evidence to present to obtain a visa approval.  No co-mingling of finances or assets, no visits or time spent together since marriage, no real relationship evidence but some wedding pics and phone records (if that).   If you two truly want to be together you should look at other alternatives such as her moving to Nigeria or both of you moving to a third country.

Just because your visa was in process doesn't mean she couldn't have visited you.  Eight years is a very long time to go with no physical presence.  I'm sure you can understand why you were denied 2 years ago.

We communicate on facebook and email not by phone most of the time and I remind you, finding a job in Nigeria is not that easy. I love my wife and she love me but finance is a challenge.

So you have not met for 8 years?

come on, this is either a troll or just....simply..stupid.

Married for 8 years and no visit at all?! I get it finances are tough but possible if u save up s few years

also...first it was you talked over 73937293 phone numbers and then mostly thru facebook and email..so what‘s the big issue to proof that?

You won‘t move to the US, face it!

if you wanna be with your wife she has to move to  your coubtry or you chose a 3rd country option but taking this thread for much longer is not making any sense...there is no other solution!

You do not need to remarry, you are already married.  Such a letter will carry no weight.

If you wish to visit the U.S. you must prove ties to your own country, not a reason to travel to the US.

If you wish to travel to the US on an immigrant visa, you must first fix the conditions under which you were denied.  I think your first step is having your wife visit Nigeria again.

Good luck

Can she send me a letter of invitation indicating we are remarrying in the states ?

She can send anything she wants but unless it is herself to you, you won't ever see her again.

She can not provide all the necessary documents .. OK for the following reasons, she is taking the paper to court, and the court will summon me for a divorce. Is it possible I go to the states for this ?

That was quick

You can appoint a US lawyer to handle the matter for you

so im new to the forums, and about to file the K1 for my fiance to move from canada to the US, and I freely admit I don't know as much as so many of the members on here .... but dude.... I think you're screwed.

What kind of marriage lasts 10 (or 8, i think you changed your answer?) and you dont communicate? You dont visit? Theres no proof or evidence of your relationship? And she hasnt filed taxes? Why? 58 is not old, why does she not work? SHE has to be able to support YOU. No proof of divorce? Did NEITHER of you think that this MIGHT become an issue? My fiance and I spend upwards of 20,000 (no, thats not a typo) minutes on the phone a month. Neither of us has ever changed our phone numbers. He comes down pretty much every 3 weeks to visit for a long weekend, pretty much like clockwork, there's dozens and dozens of photos (and not saved to just ONE device- theyre on our phones, computers, facebook, printed copies....), facebook and text messages (though most of our convos are on the phone, errr obviously), visits of me (and my son on one long trip) going up there. Give us 8 more years (we've been together 2) and all that would amplify even MORE.

Not to be mean, but no wonder they didnt approve your Visa.

Get your stuff together and reapply, but I really think this is a losing battle.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

Filed everything ourselves with no RFE's or delays.

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

I guess the simple answer is a marriage that produces a Green Card.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Does not always work out, but you have to pay to play.
