Hi again!

So i know that i don't have to think like this but i wanted to know if we get our k1 denied (hope not ) can we marry and apply for CR1?

i love my fiancé and i am so afraid that they deny our application

Yes you can. But then why not get married and apply for a CR-1 instead and save the time from the K-1?

K-1 is faster BUT you'll have to AOS when you get there you don't have to do that on a CR-1 visa.

What I meant was IF you get denied a K-1 visa time has passed you could have spend waiting on the CR-1 visa.

I can't answer what will be the best that is up to you and your fiancé to figur out.

Yes ALL visas can get denied. There is absolutely no visa that garanties entry to the us.

AOS is adjustment of status you have to do that after you enter on the K-1 and are married. It's to get your green card and work permit and all that. It's about a $1,000.

I really think you guys should read up on all this because you need to know this stuff before you get started.

Then you would fight to be together! or move to another country to be together.

What if you get in on a K-1 visa marry and get denied AOS?

I mean you have to be prepared that anything can happen you are not guaranteed to get a visa or to stay it's not a right you have.

You seem concerned that you might get denied. You might outline your situation here and receive advice on whether your application has any red flags. If your application has no red flags then you can rest easier that your application is very likely to be approved and you will receive a visa.

First off, if you're a citizen of France, not just a resident, then you will likely have an easier time. France is not a high fraud country where the application is scrutinized to a greater degree.

This is a do it yourself forum. Generally people come here for advice on how to submit all the documents themselves. However, if your case is complicated and has red flags, people here will advise you if or when to get an attorney.

Stop worrying about denial and focus on a submitting a quality petition, research the forum, use the search feature, spend some time

reading here.

When a K1 gets refused that is the end, it will expire.
When a CR1 gets refused and returned you have a second chance for a rebuttal.

Really though, unless you have good reasons to think you will be denied put your energy into what route is best for you as a couple and don't let

immigration dictate a K1 or CR1, what is it that you want ?

This is a long journey and going into the process with a defeatist's attitude before you even file won't help anything.

My best help for you is to learn how to do a lot of research. I came here in US thru K1 visa route (but I did learn about CR1, just in case I get denied). If you're well equip with different story and information your worry will be more less as you'll be more prepared than just being scared because people say this and that.

It's really easy to browse around this forum, just be more open with options and accept all the negative and positive feedback.

When you get here in US, you should know what is your next step. Your process of getting a visa here is still a long journey until you're a permanent resident or naturalized citizen.

Where there is a will, there is a way. I would strongly advise you to reflect on your relationship before you begin this journey, it is long no matter what the route. You stated: what would i do with the marriage if it is denied. This is the hurdle you tackle as a couple after, not before. The denial for a married couple is not the end of the visa, it is an extended exercise in proving your love a bit more. You are also stating you are from a high fraud country, which France is not, so are you a national from somewhere else?
