good morning to everyone at first sorry if my English won't be perfect and if I-m using a wrong topic.... however I met my fiancé matt during the summer 2013 when I was in des Moines IA for an internship in a industry. We felt in love right away and before the time to come back in Italy he asked me to married me....i said yes.... now are 2 years that we are going ahead to travel from IT to USA and the last time that I visited him, August 2014, we went to talk with an immigration lawyer to start the documents for the k1. She told us that all the process required 6 months but yesterday she change her words and, see that I asked an update about the situation, she said that the time will be 1 year.

I will graduated in march and I can't think to stay at home to do nothing for one year at first for respect my parent and second I can't think to go ahead in this situation with him,is starting to be super hard and I don't have the money to go again twice to visited him in a year and the same matt... so I don't know what do, where are near to send all the documentation to the immigration but we decide to stop everything for few days and be sure about what do. Now we are thinking that maybe will be better do the adjustment of status and get married without the k1 because we don't see other option...

Someone can help me or give me some more information? Because I don't like how the lawyer is moving everything and we are paying her, but I don't really know what is he best way to do everything. I know that maybe for some of you one year more is nothing but for me it is and I don't want destroy a beautiful relationship with the man that I love for stupid documents...

This is nonstarter, using the Visa Waiver Program or a Tourist Visa with intent to immigrate is fraud.

Your lawyer lied to you to get more money, using the VWP to marry AND STAY is visa fraud.

However, she was also wrong about the timeline- while some K1s take longer than others, 6 months is much closer than a year. Why have you not started the process yet?

Plan for 10 months, be happy with 5......is my mantra.

So if you are proposing to visit the US on VWP or a Visitor visa and get married and AOS....that is visa fraud.....since you have this intention as stated.....however VWPs do this all the time. The worst that could happen is USCIS goes hard on your case and you get a lifetime ban.

Why should your relationship suffer? If it was strong enough you two would understand the process and follow along. And the documents are not stupid; immigration to the US is a privledge (not a right) and you should be grateful the US is a country that allows that to occur....many others do not.

If you had done the process yourself, the papers would have been on their way in November. Just something to keep in mind.

Everyone else has to wait it out and it isn't the end of the world. Your relationship will survive or it wasn't strong enough for marriage anyway.

Stop paying the lawyer. Seriously, it may be more problems than what it's worth, especially if your lawyer is "moving everything" around and condoning visa fraud.

If your fiancé submits the I-129F petition now, you may likely have your visa interview this summer. You may not be waiting as long as you think. Your fiancé is from Iowa same as me, which means his petition will likely go to California, which is usually very fast on approving I-129F petitions. You just need to make sure that you have a good petition and all your required documents are there. Your fiancé will need from you (meaning you need to mail to him):

• a letter of intent to marry, signed and dated
• a Form G-325A, signed and dated
• one passport photo (2in x 2in size, or 51mm by 51mm)

Where is your (USC) fiance?

He should be one to lead this effort, and file I-129F.

You can use a lawyer, if you have the money and if they are good.

But fiancee visa processing is NOT complicated.

Many thousands have done it with self-help information from this VJ site.

I filed for I-129F in Dec/2013, and my fiancee received the K1 visa around Aug/2014.

We lost one month in reacquiring correct documents in China.

If you fiance submit I-129F now, there is a good chance you will get the visa

between Aug ~ Oct time frame.

You absolutely do NOT need a lawyer for K1. There is a very strong support group on this website and people applying at the same time as you, and people who have applied before you, and there will be many people who have applied after you.

My fiance and I have not seen each other since September, before that I visited twice (I am the USC). So everyone finds their own happy medium. You can go on small vacations togeher, share the cost of your flight here to US so you can come visit him and get to know his family and get used to the country.

From the moment we filed the application it has been 7 months, and it has been stressful, and happy, and even weird at times. This is a journey you decide to go on together. Marriage is not all happy days and pink unicorns and I believe this process is a good preparation for overcoming obstacles together.

Get your money back from your lawyer, and tell her good bye. She is wasting your time. I myself took 3 weeks to prepare all our documents, while I was working and preparing for a licensing exam. She is your lawyer and she has paralegals and secretaries, so there is no reason why it took her until now to get your paperwork ready. I work with immigration lawyers and I am telling you she is either taking your money or she is an idiot.

File for K1 yourself, and save the expenses for the wedding and visits!

You don't have to sit at home and do nothing while you wait for the visa, you can work anywhere you like and save money. In the past 7 months I have been more productive doing all this stuff at once, so don't worry, you can work and plan your future.

Don't do this. She maybe doesn't know (which means you might need a different lawyer). I know someone who did this because they didn't know the rules and long, long story short, her husband was here illegally for 6 months even though they were married (which means that he could have been deported and banned for the overstay) and they needed to hire a lawyer to help with the green card and the whole thing cost them over $6000.

If you enter on VWP with the intent to marry and stay it is fraud. If you enter on VWP with the intent to be a visitor and return home it is not fraud. If during your visit you decide to marry, it is also not fraud. It all comes down to intent.
