Refused a Social Security Number for getting married on a K-1

So I'm not sure if I'm in the wrong or the person working at the Social Security office was wrong when telling me this. Me and my wife went to the Social Security Office so that I could apply for a Social Security Number. I'm aware now that I should have done this before we got married, but we were not aware of it at the time. The person we spoke to told us that, because we had gotten married and sent off our AOS documents (still pending), that I could no longer apply for a SSN under a K-1 Visa, and that I should apply for an ITIN (for tax purposes). However my I-94 is still valid, and I have all the necessary documents. Just wondering if anyone knows if I should still be able to get an SSN after getting married?

What is the expiration of the i-94? I'm assuming it's a  month or less. The SSA office will not issue a ssn to you if you are that close to the expiration on the I-94 and you will have to wait until you receive your EAD (assuming you applied for this) otherwise you will have to wait until you get your greencard.

 

After you receive your EAD/AP combo card, take it, and a completed SS-5 application, to a SSA office. The SSN card you will receive will have the "Valid for work only with DHS Authorization" statement on it. The I-765/I-131 EAD/AP Combo card (or later Green Card (GC)) is the requisite DHS authorization document. After you receive your 2-yr conditional Green Card, you can take it, and a another completed SS-5 application to the SSA office and apply to receive another SSN card without the "Valid work..." statement on it.

Hey Prystine! The I-94 will expire within three weeks. However the person at the office straight out said because I was married I couldn't apply under the K-1 Visa as I wasn't a Fiancé, they didn't even look at the I-94. I have applied for the EAD and such and am waiting on those. I was just wondering is it true or not that I can't apply after being married? I understand not being able to apply if the I-94 is close to expiring, but I've not seen anyone anywhere ever say they were denied because they were married.

I didn't apply for my SSN until after I had married, no issue, although we married a month after arrival.  Not sure why they would tell you that.

I was able to apply for a social the day after we got married.  But I have had friends that said their local Social Security office didn't grant them a social until the EAD/GC was presented.

The trouble some have with going after getting married is because of the name change. Social security needs to verify your name, if you change your name before AOS is filed or the EAD/GC is issued they can't match up your name in the system. 

 

Other times it is the lack of knowledge with the social security office personnel. They think the marriage voids the K1. 

 

Since you still have time on your I-94 go back and hope you get someone different. If there is another office close by go there instead. Also whether or not you're changing your name don't mention the marriage, there is no point at this point it doesn't make a difference. Even if you were to change your name it's best to use the one on your visa/passport.

Yeah, like Ontarkie said there is definitely a lack of knowledge with some SSA Personnel and the K1 visa process and the person you spoke with clearly thought that getting married somehow voided the k1 which for a SSN it does not. The problem you will run into now if you do go back is that you are close to the expiration date of your I-94 and that is a valid reason for them not to issue one so depending on who you get, they may or may not issue it. At which point you just wait for the EAD and go back when you have that.
