Can USCIS tier 2 provide inaccurate or wrong information?

Timeline

I was told by tier 2 when I called asking for my EAD status based on family based and was told that my case was going to be denied or may receive another RFE.

Can this information be trusted?

It's been 85 days since RFE was received by USCIS asking for some financial documents regarding income requirements.

Can someone share some thoughts and their experiences?

Did the tier 2 at least told you the reason why for the possibly denial or RFE? I have read quite a few threads here speaking to a tier 2 and inquiring about their EAD and I have not come across a situation like yours. I would try to call again and speak to a different agent. You can also contact your congressman to help you with your case.

10/30/17 – NOA1 Received (From MSC/NBC)

11/03/17 - Biometrics Appointment Received (Appt. 11/14/17)

11/14/15 - Biometrics for I-485 & I-765 done

01/08/2018 - Received NOA2 (Request for applicant to appear for initial interview) 

01/17/2018 - EAD/AP approved (Took 92 days)

01/18/2018 - Received Text & Email regarding EAD/AP approval

01/22/2018 - Approval Notice received in the mail

01/22/2018 - EAD/AP card processed and mailed out via USPS. (Estimated delivery date 01/24/2018) 

01/24/2017 - EAD/AP card on hand

02/06/2018 - AOS interview appointment 

02/06/2018 - Interview - Recommended for approval

02/07/2018 - GC being produced

02/15/2018 - GC on hand:dance::dancing:

Actually, RFEs can be (and are) issued at any time during the process.......

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I don't understand why you would be denied? Did he say why? What was you'r RFE about?

Was your REF regarding your I-485 or I-765?

Thanks for all your kind words, my RFE was that we made 23k for a household of 3 and we used some additional assets to supplement our income to fulfill income guidelines. When I asked the reason with tier 2 for my denial, I was told that I would soon be getting a written decision in mail from USCIS- that would say why and that I need to wait. I don't know if I could believe him or not and my lawyer who filed it says I should be ok. It's all been very frustrating and confusing!

He said I would get some mail stating the reason

How can the tier 2 have the information that you "might" get denied? I didnt think they had that information?
Everytime I talk to them they say that they dont know anything and that only the officers knows what actually is going to happen.

Ya but people say tier 2 work for USCIS directly and have all correct info which makes me worried.

2. Live Assistance - Tier 1

 

Live assistance is available at published times for questions not answered by the IVR system.

 

After interacting with the IVR, the caller has the option to be transferred to a CSR at the Tier 1 Contact Center. 

 

When unable to completely resolve the customer’s inquiry, the CSR may create a Service Request for the USCIS office that is processing the customer’s case, escalate the call to a Tier 2 USCIS officer, or route the call to a supervisor, as appropriate. 

 

3. Live Assistance - Tier 2

 

If the customer has spoken with the CSR at a Tier 1 Contact Center and has not been able to obtain a resolution, the call may be escalated to a Tier 2 Contact Center if applicable.

 

Tier 2 is staffed by USCIS officers with access to applicable USCIS systems. USCIS officers may also escalate callers to a supervisor when necessary. 

 

4. Live Assistance - Tier 2 (Supervisor)

 

When appropriate, the USCIS officer may escalate the call to a supervisory USCIS officer. Calls will be routed to a supervisor when:

 

Customer requests to speak to a supervisor; 

 

Customer is unusually upset and believes the proposed resolution is improper; or

 

The matter requires urgent or expedited assistance by another office to resolve in a timely manner.

 

A USCIS Tier 2 supervisor has the ability to contact USCIS field offices, asylum offices, service centers, and the National Benefits Center through designated points of contact to address any issues that require immediate action or direct assistance. When appropriate for the situation, a supervisor may:

 

Verify the information provided to the customer by the USCIS officer.

 

Directly contact the appropriate USCIS office to determine if any additional options may be available to resolve the caller’s issue (if needed).

 

Create a Service Request if the issue cannot be resolved by the NCSC. 

 

Request that the appropriate office take action to alleviate any unnecessary additional wait times, if the caller’s issue resulted from a USCIS error.

ya I spoke to tier 2, his answer was first denied, then he said I may receive another RFE kinda vague. When I asked why another RFE he said to wait for the mail from USCIS :(

It says "Request for evidence was received on Oct'17. We will notify you a decision or if we need something from you"
