i 130 for my 22 year son

 I am a US Citizen for 1 Year and try to apply a green card for my 22 year old son from Germany.

Doese someone know how long it will take?

i try to fill out i 130 what is confusion for me.Do i should take a Lawyer to help?

If your son is unmarried you would file under the F1 family preference and it would take around 7 years for his priority date to become current. 

 

If your son is married you would instead file under the F3 family preference and it would take around 12 years for his priority date to become current. 

 

If you aren't comfortable completing the I-130 then you can hire a lawyer to do that for you, but it won't make the process go any quicker.

I only talked to a lawyer for a few minutes but i will try it first by my self.But i remember that he was saying something about 1 to 2 years because iam a us citizen.

I have never heard of having to wait. It does not make sense because once you are a citizen you have the same rights and responsibilities as any other citizen, no matter how long you've been a citizen.

 

It takes 7 years. You should have added him earlier when, he was a minor, to your green card. Things change once someone turns 21.

i now but he didnt wanted to come to the usa befor.he just told me 2 weeks ago,

so the lawyer was lying to me?

I dont unterstand why he was doing this.i have to talk to my son again

I can't say if he lied to you, but it will take at least 7 years since he is 21+ years old now. If he was under 21, then the wait would be about 1 year.

From what I've read on this forum, a lot of lawyers say a lot of nonsense.

Yes, it is too long of a wait. I don't know why they do that. You can do the paperwork yourself to file. There is no reason why you would need to get a lawyer. 

 

One way he could come to the US and spend some time here would be to study with an F-1 visa. Or he could do a work/travel program with a J1. Sure, it wouldn't be long but if he got something in the city you live in, you could spend some time together. It depends on what he wants to do and what his goals are.

 No  it is the same wait from everywhere.  The only thing that DFC gets ( where available)  is faster processing for spouses.

Just to give you more of an understanding of why the long wait happens so you don't feel that it is unfair.

 

There are millions of visa and petitions going through the process on any given day. The US immigration system is already overburdened. We have even seen an increase on timelines in certain categories due to an increase of cases. In order to manage such a huge amount of cases they are placed into categories like @Hypnos mentioned earlier (F1 and F3). Every category is treated differently in urgency. For example, and F1 (Family 1) would be approved much sooner than an F3 (Family 3). The people who fall into the F1 category tend to be those who need to be with family sooner like minor children. So when your son turned 21 he was no longer considered a minor child. He is an adult who can live his own life, work, buy a house, or have  a family of his own.

 

This is why he falls into the F3 category as he has less urgency to be reunited to his family than, say, a 5 or 6 year old that needs to be taken care, nurtured, and educated. If, for example, there were no categories, then ALL of the cases would be pooled into one and the timeline to bring family over would be multiple years for everyone. It is very hard to argue that an able bodied 21 year old who has the ability to live a life the way he or she chooses should be treated with the same urgency that a 5 year child to be reunited with their mother.

 

@Kerstin I hope this helps paint a complete picture of part the process and waiting times. This is not a punishment to you or your son. It is just a system that tries to make it fair for those more in need. It sounds like your son will be OK in waiting. You admitted it was he who decided not to migrate with you previously. if he is old enough to make those kind of decisions he is old enough to wait while others that are in more need to be here sooner can do so.

There's no such waiting time for children of USC. The current waiting time is 7 years if he's not married and around 12 if he is.
