Hello VisaJourney!

Came here for your support. We got denied two weeks ago but there is no letter with explanation. We want to file again, because this is real love and we deserved this freaking k1, but sometimes I feel hopeless. It feels like we will never receive this denial letter... I miss my man and can not wait to see him again. Feel sad :(

You posted before that you had an RFE. What was the RFE for and did you respond in the allotted time-frame for this? If you didn't provide what they were asking for or past the posted time, then this could be the reason for the denial. Once you receive the denial you can go from there to determine what your next steps are.

Hi,

I am sorry about this. Did you send all the evidences and requested forms? Could they possibly have sent a RFE which never reached your fiancé? Have you ever tried to call USCIS and speak to a Tier 2 to better understand what caused your denial since no letter was sent? I would definitely try to understand the reasons before applying again. Maybe the letter is on its way as well. I have read on VJ that re-applying is faster than trying to make an appeal.

Could you tell us exactly what your rfe said and what you sent in?

I know that uscis confirmed that they received your rfe so best guess without the denial letter is that uscis wasn't satisfied with your response.

Is there instruction under your denied status that provides direction on what to do/how long to wait for the denial letter?

RFE was about the date when I left the US (My i94 form and I did not overstay), to fill out missed gaps in I-129 in criminal records section and some other minor gaps (am I his relative). We sent my expired visa (copy) and explanation letter. So, they got more evidenses

Yes, USCIS said that we have contact them again on April 1 if we would not get a mail from them.

So it was your I-129F petition that was denied? You saw this denial status on the USCIS online case status? You should be receiving a letter in the mail then. That denial notice should let you know why the petition was denied. You can update here when you find out the reason of the denial, and then perhaps people can advise you about how to go about your next filing in order to get an approval.

We will try k1 again. We have right for this, just need to know what was wrong before... Still waiting for explanation.

Like other members said, you need to figure out WHY your case was denied and see if you can fix this reason before reapplying or not. If it's something you can't fix (like not simply wrong filled form or lack of documents) but serious and permanent issue, there is no reason to reapply, you will be denied again based on the same reason so you will simply waste a lot of time and a lot of money.

Before you figure out the reason of denial I would advise to not do anything else and certainly don't send another petition yet.

Based on the reason of denial, if you can eliminate this reason in the next application, you might be able to decide what is better - another K-1 petition or marriage and CR-1 petition for spouse. In different cases one or another way can be better and have better chances for approval.

Sorry to hear that. ? The first is only a couple of days away, then you can call USCIS, get the reason for your denial and work from there. Unfortunately, at this time, all you can do is wait. ?

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning
