USC1961 reacted to Estibaliz in No race option for brown skinned latinos
I guess that explanation makes sense, but still kind of a nuisance.

As a Spaniard with Spanish parents, grandparents, great grandparents and so on, I have to say I'm so pale I almost shine in the dark. So yes, I'm definitely white. Then it's true I'm from the North of Spain. People have that stereotype of Spain being just flamenco and bulls and sun and Arabic heritage, but where I live we are about Celtic heritage. So yep, in the end, we all are a mix.

But still have to answer that questions  So let's follow the guidelines of common sense and, as the last person said, not to stress too much about small things. Thought easier said than done...

I know. It's just different but quite a nice place, specially the people. I've been visiting twice before, five months total, so I'm ready for it

Pity the waiting is so long... And lately it seems it's going to be even longer.

Agree this was a very interesting thread, and my apologies to the OP if we are getting out of track and kind of spamming.

The government asks these questions for a few reasons.  First off for pure statistical purposes.  Second in some cases it helps identify the applicant.  Lastly it's to ensure that they aren't discriminating against one group or another.  Those are perhaps the main reasons.  But indeed, the question is difficult for many to answer 100%.  So you just choose the best option.

Case in point I'm in almost the same exact boat you are.  Since I have great grandparents from Spain, I could tick the box for Hispanic.  The thing is I'm white from European descent so no one would believe me.  The stereotype in America is If you aren't browned skin and wear a sombrero,  you couldn't possibly be from Spanish descent.  So it's easier just to mark white.  Even though it doesn't fully answer questions about my ethnicity (Catalan, English and Irish), it does correctly identify me.

In the end I don't believe this question is used as a lie detector as some of the other questions are.  Nor do I think an adjudicator or a CO is going to spend more than a second or 2 on this question.  To the OP:  If I were in your shoes just mark Latino.  It may not be the perfect answer from your perspective, but that is the word that would be used to describe anyone from El Salvador in the USA.

My pleasure.  The Philippines forum is an awesome source of detailed information as well.  So make sure you take a peek in there as well.  Sagot, Hank and Greenbaum are experts on the Visa Journey through the Manila embassy.

On that note Happy May Day! We have made it to the end of April.   Time moves on and we all are one step closer to the goal.  Let's hope it is a relatively smooth journey for us all.

Divorced is correct since you have been married in the past.  This is another question however that would be better asked in the main k-1 forum or even the Philippines forum since you can draw from the community as a whole.

I don't see any hostility here, just sincere opinions.   We all realize how difficult and life changing this process is and 10 times that when something goes wrong.  Which is why people are pointing out the fact that the chances at this point don't look very good.   If the OP can stay legally, welcome and more power to the OP.  However you aren't going to find much sympathy on here if the OP plans to overstay.

USC1961 reacted to geowrian in Was not aware of the I-751 requirement
She was required to file for ROC (as you are now aware). I don't mean to pick on you or her, but it was her responsibility to research what was involved in the green card process. Not knowing about a requirement, and not updating your address as required, is not an acceptable explanation for USCIS.

Here's the "official" answer from USCIS:
    https://my.uscis.gov/helpcenter/article/what-happens-if-i-don-t-file-form-i-751-during-the-90-days-prior-to-my-2nd-year-anniversary-as-a-conditional-resident

That said, there are some technicalities involved...while your green card expired, your LPR status actually won't terminate until an immigration judge does so. However, you can file late and attempt to prove a "good cause" for doing so.
    http://www.nolo.com/legal-encyclopedia/submitting-late-form-i-751-petition-remove-conditions-residence.html

I would suggest seeking out an attorney to discuss your case and prepare to present a "good cause" case. Presentation of the evidence does matter for things like this IMHO...

You cannot obtain citizenship until you have completed ROC.

USC1961 reacted to Lenchique in Wife Been Arrested
This is such a tough situation. On the one hand it would be financially a burden for him to buy a ticket and who is to say she will get in the plane? He can't force her. Someone as vile and attempting to be shrewd (as evidenced by her threatening statements to him "you will pay") is hardly the kind of person who can be talked into leaving the best country in the world. Plus isn't she needed to be present for a divorce proceeding ?

On the other hand if he doesn't buy her a ticket who is to say she won't be a menace to him and cause more grief? Plus, given how back logged deportation department in homeland security is, if doubt if they would get to her any time soon. Meanwhile she could be doing unpredictable things.

but either way keeping her in jail without bailing her is the best for her and him.

    1. No its not necessary for both to sign.  Only the petitioner needs to sign and date it.
    2. For the passport photos you only need to write the name on the back as the instructions indicate.

Thanks for the cover letter.  If you google I-129f cover letter you will also find many more examples.

As stated above you are fine.  The person who helped you followed the instructions correctly.  In any case, if it was missing you would get an RFE and a chance to correct it.  Good luck!

Note my answer above.  The easiest way to do this is pay them off then open your own accounts.  The old ones will just fall to the wayside.  As it sounds like he just wants to move on with his life.

Very common as I found out first hand.  It's a widely accepted cultural practice, no one blinks an eye.  What it boils down to is an easy way to adopt.  Or an agreement to take care of a relative or friends child, when they have had 1 too many.   At first this caught me off-guard because in most places the BC is considered a sacred legal document.  Sad part is they make it extremely difficult to correct a BC, while easy to file one with a "mistake."

Bad customer service, poor on-time record etc etc etc  Just do a google search for United airlines, there is a lot of recent negative press.  Granted if you aren't a frequent flyer and are just looking for cheap prices it's probably not a big deal.  But personally United would be far down my list of choices, even if going on another airline  means it cost a bit more.  Fortunately SEA isn't a big hub for United so It makes it easy to avoid them.  And flying to Asia is easy with plenty of choices from here.

USC1961 reacted to EandH0904 in Bf was not admitted 212(a)(7)(i)(I)
Intending Immigrant [INA § 212(a)(7)(A)(i)(I)] – This is the most common ground of inadmissibility applied under INA § 212(a)(7).  Any foreign national who seeks to enter the U.S. and remain here permanently, or who is suspected of seeking to enter the U.S. and remain here permanently, but who does not have the proper documents to demonstrate that s/he has authorization to do so, is inadmissible.
so it looks like the statute with which he was denied admission, intending to remain here permanently, is exactly what you stated you were intending for him to do. Marry him while he's here and adjust his status.

Renember its visa fraud to come here with the wrong visa, and it makes it that much harder for us who are doing it legally. No one likes being separated from their loved ones. It's difficult for all of us.

So if you are ready to go there and get married that's probably in your best interest to do them file CR1.

Ohh my...it sounds like the medic found something in his blood test that indicates he does drink too much.  This is not a small detail.   Combined with a former DUI it sounds like the CO made an informed logical choice here. Telling you to apply again in 6 months is a nice way of saying you're denied.   Your husband needs to go to AA and some alcohol counseling and needs to stop drinking if he wants a chance of getting approved in the future.

Bingo!  Let's not downplay the dangers of alcohol here.

The thing to learn with this whole process is never try to set firm dates for anything because you may go pass those dates. This happens all the times where people set dates for things such as flights and ceremonies, then due to no fault of their own have to forget about those dates due to delays in the process.
