    Don't forget to make sure that the Soc Security Admin has the updated info that your stepson is now a citizen. It will affect his ability to obtain federal college loans if he is not.
     
    My nephew is going through that process right now, and already had his passport for several years. But he had to go to the SSA office in person and set the record straight before he was eligible for FAFSA.

    Update - applied for my stepson's passport with Mom as the qualifying USC.  Used Mom's citizenship cert, stepson's birth certificate and greencard as documentation  and a passport arrived in under three weeks with regular processing. 
     
     Thank you for your advice.

    Oh this may be a year late to reply but you are WAY WRONG. The only reason that group requires members to speak English or Tagalog is because everyone understands those languages unlike Bisaya which only a few can understand. Do you get it? In order to have unity, we need to have a common language understood by all. Just like with me responding to you in Tagalog, would you like that? No, because you don't know the language.
    No Pinay needs a support group? The group is more than just that. I have a happy life and a wonderful husband but there are things I'd rather ask other women for some things, specially those that have gone through the same process and will understand the situation better. I've actually made a lot of real life friends from that group so don't discount it and act like you know what you are talking about when you clearly dont.

    Doesn't matter if you're the petitioner or respondent in the Annulment case, you'll be required to go through Psych Eval for additional 1000php. Bring the court decision with you at the time of the medical exam. It will be on a separate day so make sure you have enough time in between your interview date.

    ^^^ True, and by that time, the I-129F petition should be approved.
    Even if the I-129F petition isn't approved during the next two months, the odds of a Manila K-1er getting a visitor's visa approaches zero.

    Sorry but there is NO NVC process at all for K-1. They assign a case number and forward it directly to the interviewing embassy/consul. NO forms NO information no nothing is sent to the NVC.

    My step-daughter is 4. The Screener did not ask her any questions. However, the Consulate Officer did ask her a couple of simple questions (name and age). For a 12 year old, they may ask more.

    Here's my opinion:
    1. Get the Japanese divorce decree and have it translated into English by a private professional translator.
    2. Then, file the I-129F.
    3. Have your fiancée interview for her fiancée visa at the U.S. Embassy in Japan.
    4. Once she has her visa, have your fiancée fly from Japan to the U.S.
    More opinion:
    The USCIS and the U.S. Embassy in Japan will acknowledge her as being single and eligible for a fiancée visa because she's divorced, and the U.S. recognizes divorce. The Embassy will issue her a visa.
    She won't need a "recognition of foreign divorce" from a Filipino court because she is not leaving from the Philippines after she receives her visa. If she were leaving from the Philippines, she would need the "recognition of foreign divorce" because she wouldn't be able to get a CFO sticker without one. She would not be able to board a flight in the Philippines to the U.S. without a CFO sticker.
    If she leaves for the U.S. from Japan, she won't have to have a CFO sticker in her passport.

    OP, I would be careful here about making assumptions. There are some things that seem very clear in filipino law, but some don't seem clear at all. Normally a mother in this case would have sole right to the children. But if I recall from your previous posts the oldest child has spend significant time in the care of the paternal grandmother. The fact that the child is over 7 and has spent significant time in the father's care (could be just the grandmother, but in court I would expect it to be presented that it's time in the care of the father), I don't think this will be cut a dried. I would get a good local attorney. Although some will say the mother has all the rights, which is normally true, I don't think this case will be as cut and dried.
    Another thing, your story presents the father as a horrible human being. This is, I am certain, only coming from one side: your fiancee's. He has done some bad things. At the same time he or his family are taking care of his child, he has gotten his nursing degree, and he's secured a Canadian visa allowing him to go there to work. Put these together and it looks like he's been studying and working hard to secure the future of his family. I'm not saying this to say he's a great person, but there is a whole other story here that I'm sure you're not seeing, but will certainly be presented if this goes to court. If his family has contacts that ease his ability to get the judgement that he wants, there is a fair amount of risk for your fiancee. Given the "other side of the story" they may very well be able to present your fiancee as the "bad" person and the ex-boyfriend as the one who has been working for years to provide for the future of his family. Again, I'm not supporting him, just trying to give the alternative view that may work against your fiancee in any future custody battle.
    Sorry you find yourself in this situation, but you may be in for a difficult battle in the future. IMHO, your fiancee must get a good local attorney ASAP and get this moving.

    there is no such thing as common law marriage in the phil and if any childern were born between the two parties by phil law the mother has full and unimpeading rights to the children as they are illegimate further if the mother so chooses she can immigrate with the children as long as the children have passports,which can be obtained by the mother easily as she has full custody under the law because she was never at anytime legaly married to the childrens father,my advice would be to have absolutely no contact with the ex or any friend or member of his family!!!!!theres nothing that your ex can do to stop you from immgrating with your children with the one who really loves you!!!just have all your proper paperwork for immigration n for the embbassy interview and passports for you and the children and your good to go,just completly stay away from the ex n his family till you immigrate!its actually illegal what and how the ex's mother is trying to do n how shes trying to draw you into something which yes can be undone its called human bribery on a selfish level,but would take months n alot of court dates in manila please just take my advice!!!!!!!!

    My wife is to depart for Lackland Air Force Base, Texas, on March 20, 2013, to start her basic training. She is physically prepared. She exceeds the physical requirements of a 17 year old in the push-ups, sit-ups and run. I am just proud of her. Here she is, an immigrant to this country from the Philippines, the mother of our son, and my wife, and she is serving this country as an airman with an Air Refueling Wing. And God willing she will have her oath of naturalization the Thursday before she graduates from basic training.
    Just am very proud of her...

    If you get a divorce in the US and you are the one seeking the divorce (the plaintiff) then the Filipino citizen can have the foreign divorce recognized by the Philippine court. What you want to ask about is recognition of a foreign decree of divorce by the Philippine courts, she will need a lawyer for this. This is the easiest, quickest way and least costly.
    As a American citizen, if you get a divorce in the US then you will be divorced, you do not need a annulment in the Philippines. The Filipino citizen is the one who would need to have the courts recognize that foreign divorce in the Philippines, before she would legally be divorced in the Philippines and free to remarry.

    What do you mean, "sent home"? If you mean deported, there's not much chance of her coming back. If she went home voluntarily without USCIS involvement, maybe. The petition must include a copy of the annulment documents, so if they indicate a judge granted the annulment due to marriage fraud associated with immigration, the chances of petition approval or a visa are very slim, if any.
