I put in for a fiance visa k-1 7 months ago it finally got approved. my fiance put in for her annulment and that is still not approved. this whole thing is pretty much null and void huh. I know she will get denied at the interview without the proper paperwork. i know i should have waited to file. well i didnt hind sight is 20 20. i guess my question is, do we just leave it go and not show up to interview? do i send uscis a cancellation? do i reapply when her annulment is finally finished? and does this all hurt her chances of being approved in the future? any insight will help.

My suggestion is to withdraw with explanation and then refile when both are actually free and clear to marry. You will be denied.

that's what happened to me backed 2009, yes you need to cancel the approved k1 petition, send a letter to USCIS if the approved petition is still there, and you can re-file again after her annulment and pay the fee...

This is a serious mistake. It is prejury to state you are Free to marry when in fact you are not. Let alone it is possible she will get a life time ban for a material misrepresentation ie.. signing the document stating you were free to marry. A material misrepresentation to gain immigration benefits can carry a life-time ban from the US

I am nopt trying to be harsh but I want you to prepared that this could happen.

that's what happened to me backed 2009, yes you need to cancel the approved k1 petition, send a letter to USCIS if the approved petition is still there, and you can re-file again after her annulment and pay the fee...

so this exact situation happened to you? the package has been forwarded, can i still cancel. when this happened to you they didnt put a life time ban or any other negative things. this was honestly a mistake believe it or not.

lol.. no... my previous k1 petition reached the US Embassy stage so what my fiance (now my husband) did, he sent a withdrawal letter to US Embassy, Manila, Philippines and stated that he is revoking the said petition and the US Embassy sent me a informed letter about that, after i got the finality of my annulment then we re-filed again, same petition, same petitioner... i got approved, now i am here with him, we had a baby just this year and by nov. 2013 is my ROC... good luck!

lol.. no... my previous k1 petition reached the US Embassy stage so what my fiance (now my husband) did, he sent a withdrawal letter to US Embassy, Manila, Philippines and stated that he is revoking the said petition and the US Embassy sent me a informed letter about that, after i got the finality of my annulment then we re-filed again, same petition, same petitioner... i got approved, now i am here with him, we had a baby just this year and by nov. 2013 is my ROC... good luck!

This whole thing has been one speed bump after the next. now it feels we have a mountain sitting there. we had filed thinking we were clear. then when she went for her cenomar is when we ran into this. Im just happy to hear everything finally worked out for you. I was really worried there would be negative consequences to my fiance. so i guess i will be sending that letter tomorrow. is there a format i am supposed to follow? congrats on having your baby!!!

you are very much welcome, but the good thing is you still have time to prepare for your next application, dont worry, she will not have any problem, i understand and know the feeling bcoz been there and been that too... the consequences are long waiting again and of course paying another fee again... yes i will give you my link for the pattern... uhmmm if you will gonna re-file within 2 years bcoz you had a previous k1 u need also an IMBRA letter... :)

this is the link of our IMBRA letter to the USCIS... i asked my husband what he wrote to the letter he sent to the US Embassy,Manila, he said just make a simple letter explaining why you are revoking the petition and enclosed to the letter all the important informations same what's in your imbra letter... good luck...:)

BTW: after my husband sent that letter to the US Embassy i got a letter from them also informing that my petitioner revoked the said petition...
