    It would be better to post here exactly what this notice says or you will sort through 1,000 guesses. I suggest you make an Info Pass appointment right now. Sit down with USCIS to find out exactly what is wrong including the possibility they made a mistake if what you said about your situation is correct there is no reason for a denial at this stage. Something you left out or info you submitted cause this to happen.
    I agree its strange that there was no RFE for example. If one was sent and you didn't get it or respond it would could cause a denial.
    You may be able to overcome the denial if you can quickly react. Do not wait any longer than you have to take action.

    On the immigration issue, you will be able to remove conditions on your own without his cooperation or approval.

    They don't give you anything. They don't assess the overstay the second you leave, it's something you know, or something you'll find out when you try and enter again. You are already flagged as a VWP abuser, have no doubt about that.
    Those people telling you this are doing you a disservice and have no idea how US immigration works. They WOULD do exactly everything that "everyone" keeps saying they won't.
    They won't let the baby starve of course, but don't think they'll let you enter JUST because you have a baby. In fact, they'll probably ask if you have someone else that can take the baby, and when you say your husband is a USC, they'll be all over that and just send you back unless you think you can take the baby, safely, back.
    You already HAVE overstayed. Your word means nothing now. You are a VWP abuser, and have no regard for US immigration laws. You are, to them, no better than a criminal and could be treated as such. You said you came in August, that your VWP expired in Nov, and you left in May. You also said less than 180 days of overstay. Without exactly dates I'm going to assume you're pretty darn close to 180 days, though honestly it doesn't really matter.
    You have already abused the VWP and shown disdain for US immigration laws in deciding you'll "just overstay a little bit". The 180 days only matters in that more than 180 days = ban BUT less than still means you overstayed and still makes you ineligible to use the VWP.
    The child is a USC, the child will not be turned away. You could be. Your child could still enter with your husband as they're both USCs.
    Honestly, it is highly likey that you will be denied entry, detained until there's a flight back to the UK (or other European country as your passport permits entry there - they do not need to return you to your home country, just somewhere you're legal to go) and shipped right back. Your husband has no rights to be with you while you're detained and interrogated. He is a USC and will be let through.
    You need a visitor visa, not the VWP.
    I'm not trying to be mean, I'm trying to get you to see, the things you fear, are highly likely to occur. This is very very serious. US immigration aren't nice about things like this. In my personal opinion, your husband should take your child to visit your parents, you should remain in the UK. OR postpone the trip until you have applied for the visitor visa. Though you can still be denied entry on the visitor visa, you will have addressed the overstay at the interview for it, which should remove it as a risk.

    Many hard working parents, mostly Fathers, are caught in a vicious cycle of child support arrearages. While the child support obligation could end at 18 (some go to 21 and even longer if higher education coverage is written into the divorce decree), it is the arrearage that causes the issues. Mostly.
    It is usually not the support itself that causes issues but the arrearages which can be caused by loss of employment, medical condition or fabrication of facts by a vindictive Ex. The state collects $2 from the Feds for every $1 collected in child support payment so the interest of the state is to create a situation where by a payee is stuck in the cycle (follow the money).
    OP has my full sympathy and support and I don't even need to know his story and he deserve his own happiness too wherever he might find it. I personally think it is unconstitutional to tie in child support arrearages (not support) to credit profiles and governmental benefits including passport, etc. I personally know two international sales people that lost their jobs due to loss of passports. It's a silent epidemic.
    OP, I wish you nothing but the best in your journey but you will need to get your passport back and travel to meet your Fiancee. You do not need to pay the full balance to get your passprot but will have to negotiate and demonstrate a payment pattern. Hopefully this hasn't caused you to loose your livelihood.

    To be fair, the OP asked if his fiancé can come here on a visa and marry him on that, so I would think it is relevant. As far as the question, yes, you can marry with a tourist visa, as long as you honor the visa and return or, if you don't return, file the necessary AOS paperwork with reasonable proof that you didn't commit fraud in misrepresenting your true intentions.

    One of the requirements of the I-129F Fiance visa is that you MUST meet in person within the 2 year period prior to filing. There are not many valid reason accepted to forego this requirement. You can find the requirements of filing on the I-129F instructions here: http://www.uscis.gov/files/form/i-129finstr.pdf
    Look on page 4 "Who May File Form I-129F" for the valid reasons of not meeting.
    I am not very familiar with the way things work in the Philippines, but I have heard that her getting a tourist visa to come to the US to meet you could potentially be very difficult. I'm sure others from the Philippines will provide you with more information on this.
    I would assume that in your situation the best way to meet the qualifications for filing the I-129F would be to catch up on your child support payments, get a passport, and travel to meet your fiance.
    You may also want to research the financial implications of filing an I-129F. This is not an inexpensive process.

    No, it should not nullify the k1 as you can travel to the USA while the k1 is in process, the foreign applicant will have to show strong ties to the phillipines to show she will not remail in the usa. Which there is a near 100% chance she will be denied. Once you have proven that she cannot obtain a USA visa,mother you satisfy that portion of what uscis is requesting. Not sure how long the embassy takes to process grousing visa requests, but I would imagine that she could get the denial by the July 15 deadline? But someone else will have to verify that.
    On a personal note, please be careful bringing over someone you have never met, there are soooo many terrible stories of pain, expense and heartache from others that have taken advantage of your situation...

    For others (non-UK interviewees) who are reading: This question comes up too often, and there are several threads about it. For I-129F petitioners/K-1 interviewees to refer to themselves as "husband" & "wife" is similar to loading a 6-shooter with 6 bullets, putting the gun to one's head, and firing. Avoid giving anybody -- at USCIS or the consulate/embassy -- any reason to deny the petition or refuse the visa.

    While going through London is one of the easier consulates/embassies, anything that resembles a wedding really should be avoided until you have the K-1 visa in hand and you're in the U.S. And the fact that you're calling it a wedding could lead to issues. There are more than a few cases of VJers who did a ceremony that was very wedding-like (or had relatives with public Facebook profiles calling it a wedding) and were denied visas because they couldn't prove they really weren't married.
    Either dump the I-129F petition process, get really married, file the I-130 petition for a CR-1 visa and then go home and wait or skip the faux wedding altogether and continue on the path to a K-1 visa.

    Getting a K1 or CR1 visa is a special trial by fire in part caused by the huge amount of fraud that happens there. It is almost the norm to have to file twice. More than one Nigerian to Nigerian couple I know have been denied the first time let alone the ones that are not Nigerians. The people there at experts at decieving each other. Go to Lagos and you will see "this house not for sale beware 419 " stencilled on buildings. Their culture allows that a fool and their money are soon parted. It is not the same world there. Whole families will assist a member to get to the US. If they are lucky to win the lottery that is the path they will take. If they find someone that they can sweep off their feet to get here , that is ok too. Not all behave this way, and those that have honest relationships have to go the extra yard to prove they have not been taken advantage of. I know of many horror stories through the years. The one that happened last week. Another where the Nigerian wife played the part of a sister living in the house while she served food to her husband and his USC sweetheart. Stories of wives sent home to the village while the USC is visiting. Some are playing multiple woman at the same time looking to see which will bear fruit the fastest. This is why Lagos wants to see that you have spent significant time together. That you know his family. That you know the culture. They know all to well the dismal long term success rate for marriages from Nigeria. Yes many relationships are true and survive the test of time. Not a single person currently going through the process will stand up this moment and say that their relationship is anything other than 100% real. But I have seen too many find out after spending years of their life and tens of thousands of dollars that they are the stepping stone for a man , his wife and the rest of the family to come to the US because there is no other viable path for them. Be aware, be educated and be safe.

    chatting online is not even close to meeting in real life. You are never in a million years going to know what someone is truly like until you have spent time together in real life. I don;t care how much time you have spent making google eyes at each other online, the fact is anyone can be nice and charming while sitting in front of a camera. Not to say that it won;t work out after you meet, but Nigeria is the highest country when it comes to fraud. You need to take a trip there and learn each other idiosyncrasies before you make such a huge, life changing decision. What if he had habits that drive you crazy, has a bad temper, mistreats you or vice versa? Use you head and not your heart. No one here is trying to talk you out of anything, they are merely pointing out that you really need to spend some serious time together in real life, longer than a few weeks. A few weeks is just a vacation...use common sense, and read the Nigeria portal. One beloved VJ member who petitioned her Nigerian husband found out the day before her husband's interview in Lagos, that had just married ANOTHER women in Nigeria a few weeks earlier, yes he committed bigamy, and she had no clue and never would have known unless someone blew he whistle on him. This was just last week....

    Please consider carefully the desire to marry someone you have never met in person. Learning how you travel together, live together, do finances, take care of personal things, family, all these items will dramatically affect your marriage. This person may be very lovely and charming online and on the phone, but you two may discover that taking a vacation together is an absolute nightmare. You pack light, he brings the kitchen sink. You like to go to the beach and relax, he wants to hike through the jungle for 5 days and camp. Really please, if you are truly to be together, take the time to learn these things. My fiancé and I have known each other for 5 years and only been dating for just under 2. We have seen each other multiple times, learned the quirky things about each other and learned how to adjust. This stuff can get really complicated if you are married and have the pressure of trying to make it work just because. 20 years from now, you will find that the 1-2 years of being engaged, seeing each other, surviving a long distance relationship is nothing to what you have in the end......
