    Visa's are handled by Consulates. When did she leave? Assuming she is eligible the Consulate will give her the opportunity of filing a waiver when refusing the visa due to the bar.

    Others will disagree but I take a simplistic approach of filing, ok you owe nothing, but just remember who you a dealing with.

    Petitioner is for an Immigrant visa, you have no involvement in someone elses visitor visa application.

    I would expect to go to the Consulate but not sure what fees they are thinking of?

    You have to be in status to adjust other than through marriage to a USC i am wondering about the overstay on the B before you got TPS, anyway that finishes next month

    I would imagine you need a new medical at least?

    Adjustment is not an option due to your lack of status, adjustment through marriage to a USC would work.
