Might have been some editing that impacted my reply. So 2026, you can not use the 3 year rule when you are no longer in a good faith marriage. theoretically under the 5 year rule the marriage is no longer relevant but I have seen cases where people have been asked about it.

You can apply to naturalise 5 years minus 90 days after the start date on your GC. The N400 asks about your marital status etc. i assume this will be mid 2028, I would not apply the day you are eligible, give it a week.

I remember when I 601a came in, the whole thing made little sense to me, including why if you were here illegally you would give your address and contact details, sort of I am here come and get me. Gives you no status, and I never came across anything that said we will not deport you, not like say DACA. But then waivers strike me as silly, just a question of presentation, money and waiting, waste of everyone’s time.
