Exactly, there it says"... Petitioners living abroad... ", he's been living there for a number of years and his migratory record should prove that. It doesn't say petitioner must be a legal resident or citizen abroad. There are lots of cases in this forum that prove my point.

I think you should find yourself a job in the US, that starts relatively soon (like in the next 2 - 3 months) and once you have a job offer, you contact the consulate explain that you have a job opportunity starting soon in the US, and would like to apply for DCF for your wife, and that should do it. You have to prove that you are resident in that country though (they normally don't care about your residency status, meaning legally). If you have pay stubs from your job there, leases, businesses, and of course your migratory record would be great help to prove that you reside in that country. Good luck!!

Hello everyone, first of all thank you for reading this and for your answers in advance! So, I am a US citizen, got married last year after 9 years of relationship, me and my wife have a 3yo baby. I've been residing in Peru for the past 5 years, but we have decided that it's time to go back to my hometown in the US. I'm about to receive a job offer for a decent, but not quite "well paid" job. It will start in 1 month from now, so we're starting to plan the moving. My wife is Peruvian, so we're planning on doing DCF in the Lima consulate. The issue is that we don't know how long this process takes. I don't know if I will have enough time to go to the 1st interview to file the I-130 for my wife, before I need to go to the US and start my new job. Like my wife and kid can stay here for the whole process, but I know I have to be present for that first interview. Has anyone here been through DCF in the Peruvian consulate? Could someone share their timeline please? 🙏🏽 Like, I would like to know how long it takes for the embassy to reply with the approval for DCF, and how far out they schedule the actual I-130 filing interview once you confirm you have all the documents ready. Hi! I think you should be able to request DCF again, since your situation has changed and you are required to be in the US for your career to move forward. I have a question though, would you please share your timeline details? Like how long did they take to approve your request since you sent the first email requesting DCF? How far out was the appointment they scheduled since you guys confirmed you have all the documents requested? Thanks a lot!
