Seems these waivers have a high success rate. And when adjusting they can be filed with the application. And are much quicker. Downside is the filing fee x3 plus the cost of legal assistance in their preparation. -
If it was me: Delay the children's I 130 so they do not need to go the interview, medical etc. I would have the I 601 ready to file after the interview, seems a clear cut overstay case. Unclear of a Lawyer is helping with the Waiver, this sounds like a case where a Lawyer is needed, now not all Lawyers are equal and some specialise in this area, if one has not been appointed I would go with one for them rather than a generalist. I have seen no end of Waivers filed and for a simple overstay a well prepared waiver has a very high approval rate.

The policy allows up to 30,000 migrants from Cuba, Haiti, Nicaragua and Venezuela to fly to the U.S. legally each month if American sponsors agree to support them financially. The administration first started the program in late 2022 and expanded it in early 2023 to dissuade migrants from those crisis-stricken countries from traveling to the U.S. southern border. The Department of Homeland Security said it stopped issuing travel documents to people applying for the program while it investigates applications filed by U.S.-based sponsors. "Out of an abundance of caution, DHS has temporarily paused the issuance of advanced travel authorizations for new beneficiaries while it undertakes a review of supporter applications," the department said in a statement Friday. I do not understand what the basis of the expedite is, does not seem to fit into any of the categories. Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to timely file the benefit request or to timely respond to any requests for evidence; Emergencies or urgent humanitarian situations; Nonprofit organization (as designated by the Internal Revenue Service (IRS)) whose request is in furtherance of the cultural or social interests of the United States; Government interests, including cases identified by the government as urgent because they involve the public interest, public safety, national interest, or national security interests; and Clear USCIS error.
