pch1 got a reaction from JR loves JR in Unwilful Fraud/Misrepresentation, Not Charged, AOS Filed
Op, I think you have more than enough answers in this thread. I wish you the best of luck with your case. Maybe you should leave it at that and move on no matter if someone was rude or not, even most members were trying to help you in anyway they can. Sometimes replies are not what we like to hear or read, but this is the way when you are dealing in a community thread...I have been banned her few times for breaking the rules and policies and I learned to live with or leave...I opted to stay and adhere to the policies no matter what...Someday this VJ will be something of the past with many thanks for all the help and learning I had in here...
Best wishes to you, think positive and hope your case can be solved in your favor.

You can work while you are in F-1 status. You can either work for the school (which I did while I was a student) or you can apply for CPT (Curricular Practical Training). I've heard that a lot of people who do CPT end up being sponsored a H-1B visa by the employer once the F-1 status ends.
I really don't mean to be rude but you seem to be attacking OP right out of the gate...It's not our job to determine if the document is fraudulent or not, that's up to USCIS (and OP says they have already found that out)...it's our job to give advice to other people with visa related issues.

pch1 reacted to KayDeeCee in Am I a multiple filer for a I-129F?
No. You stated this is your first petition for a K-1.
From the I-129F instructions > http://www.uscis.gov...i-129finstr.pdf
2. What Filing Limitations Does IMBRA Place on K-1 Nonimmigrant Petitioners?
You must apply for a filing limitations waiver if any of the following apply:
a. You have previously filed K-1 petitions for two or more beneficiaries; or
b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously
approved petition.
To request a waiver, submit a written request with this petition accompanied by documentation supporting your claim
to the waiver.

pch1 reacted to KayDeeCee in uscis App message
I do not think a 2 year old post about past service center transfers has anything to do with the OP's current case status.
~ Moved from K-1 Process to K-1 Progress Reports -topic is case status ~

pch1 reacted to Georgia16 in K2 for child fee for D160
Yes it's a separate fee for the child also the medical is also separate for the child. And yes the AOS gives a "discount" if it's applied for along with the parent.

pch1 reacted to JFH in How do you prove ties to your home country when the CO doesn't ask questions?
He might have ties to Haiti but his ties to the USA are stronger. Love is the strongest tie. Cars can be sold. Houses can be sold or returned to landlords. Jobs can be quit. A new car can be bought. A new apartment can be rented. A new job can be found. But he only has (and wants) one girlfriend.
And what if the baby shows problems caused by zika virus? Are you going to stay in the USA? The treatment and care there is surely better than Haiti. So the CO is thinking "who would leave their girlfriend and sick child to go home?".
Unfortunately too many boyfriends/girlfriends/spouses have presented themselves as tourists at the border and then had an epiphany moment and decided their "very strong ties to home" that they took great trouble in demonstrating to the CO suddenly aren't so strong after all and can be broken.

pch1 reacted to KayDeeCee in received my I-797 now what?
The I-797c is the receipt notice. (NOA1). The approval notice(NOA2) will be an I-797.
https://www.uscis.gov/i-797-info
This is exactly what happens when your petition is received at the Dallas Lockbox > http://www.uscis.gov...ons-and-answers
The Lockbox Service provider performs the following activities when processing incoming applications:
Receive, open, sort and stage mail. Prepare and scan documents. Enter document data in system from scanned images. Accept or reject applications and related fees based on business rules. Balance applications and fees. Deposit payments to the U.S. Treasury Send receipt notices for accepted applications to the applicant and designated representative. Return rejected applications to the applicant or designated representative. Transmit application data to USCIS and payment data to U.S. Department of Treasury. Send application files to the appropriate USCIS service center or field office for further processing. Your receipt notice (NOA1) will contain your receipt number and the service center location that your petition was sent to. Currently they are all being sent to California (CSC).

pch1 got a reaction from Roy&Chanel in facebook account name
From my understanding that Adjudicators spend an average of 15 minutes on each petition, even thought proof of relationship is required they might and might not look closely at it at this stage. On the other hand, proof of relationship maybe of more importance at the Embassy during your interview with the CO. If and when the time comes and you are asked about it, then you can be honest and tell the truth. CO's are trained and smart when it comes to finding out the truth and I personally think you should not worry about it specially if got approved and receive NOA2.

pch1 got a reaction from winn55 in Abusive Wife
Listen, the cops got involved as you said, they came over, she went to her family then she came back. Man oh man, you need to protect yourself, you need to report every little detail, you have the name of the officer and his/her number or just go straight to the police station and just make them aware of what happened. Just be careful.
Come Monday, speak to a lawyer, pack and find another place to move to and let the law take its course...what are you afraid of? Loosing your Green card or what? It is not as simple and easy to take away a green card, there are procedures and hearings, you just have to document everything and stay away from her. You knew about her medical condition, you tried to help her out, you both went to counseling and all this should be counted when the going gets tough.

pch1 reacted to Pennycat in Most Recent Processing Dates for CSC
Yep, with timelines as relatively short as CSC is seeing these days (smaller numbers to deal with, which are more easily influenced), it only takes about a dozen people to wait 2 weeks to update their timeline (or not update it ever) to move the "average" up 2 days.
Looking at the data itself, (Igor's list), is better than the days/dates chart if you're going to want to be really "in the weeds" on a timeline estimate. And remember, and remind others: update your timeline!!!

pch1 reacted to Pennycat in Most Recent Processing Dates for CSC
First things first: the people on the phone don't know anything. Don't believe a thing they say, they cause more trouble and stress than they help solve. Sad but true, and pass it along. They're known as the misinformation line for a reason.
Second: I strongly believe they've made a mistake. I had a whole long reply to this but it got lost when this thread was moved to a new forum. I used to deal with these processing times for an old job, and have been following them for 2 years as personal interest, so bear with me here, and ask questions if I'm not clear (I've got to re-write this fast, I'm on lunch break).
Compare last month's to this month's (AILA archives these). You'll see that this month, all visa types have dates reported whereas last month it was 50/50. I think that one of two things is happening here.
Option 1:
Some new person was given this information to upload and didn't understand the way the chart is supposed to work (because, as we all know, it is a ridiculous system in the first place) and calculated the dates without realizing what he was doing. Evidence of this is that the ones that were months last month, are calculated to a date that is "X months" before May 16 (when this chart went live). See? For I-129f, December 16 is 5 months before May 16. I strongly believe that this is what happened.
Option 2:
They've tried to change to provide a more "live" idea of what is being processed. This is in theory possible because look-- that chart is "As Of March 31". Meaning that it would be telling you that As of March 31, they were working on December 16th filers. I really doubt this is the case because first, it is provably false (go into Jan and Feb filers threads and you'll see plenty of folks approved before March 31) and second, giving applicants accurate timelines is NOT what USCIS is in the business of doing.
The main thing to remember about this chart is that it's only purpose as far as USCIS is concerned is to draw a line in the sand on who may and who may not have a formal inquiry into their case. Even if your Senator personally is on the phone with them, they won't look into it until you're beyond those months, or outside the posted date. That's it. That's all they want it for.
It not helpful at all in getting you a more accurate timeline because they update it on or about the 15th of every month with "as of dates" at the end of the month before last. Meaning: when it is published, it is 6 weeks out of date. And they don't update it for another 4 weeks. So it is always 6 to 10 weeks out of date. Stick with the VJ timelines. They are FAR from perfect but they are much better than anything USCIS has to offer. And remember to update your own timeline and encourage your peers to do the same. Accurate and fast timeline updates is what makes the data accurate. If enough people wait a week or two to update their timelines after NOA2 (or never update them at all), the data gets totally thrown off and is inaccurate.
Finally, back to the people on the phone. EVEN IF that chart were accurate to the day it was published (on May 16 they were processing December 16), that's not a backlog. That's within 5 months. Meaning no backlog. But that chart is "As of March 31"). Meaning 3.5 months. Meaning no backlog. And that chart is wrong and out of date *anyway* and the truth of the matter seems to be right about under 3 months. Meaning.... no backlog. Now, a lot more than last year, for sure, or even just a few months ago, but still well within the timeframes given when you signed up for this crazy ride. The people on the phone don't know, and more accurately don't care. They probably spend 8 hours a day saying "backlog in the system, can't inquire until you're out of timeframe" and don't realize how much stress and confusion they can cause by giving the standard line to the wrong visa category, to an applicant who knows *much* more about the timelines than they do. Don't fall into that trap again.

pch1 reacted to Penguin_ie in broke up. how to cancel my k1 visa.
1. Send the embassy a letter stating you are cancelling because you and your petitioner broke up. Follow up with a phone call about a month later to make sure it is all done.
2. should be done within a month, usually quicker.
2. Yes. There will be suspicions that you are cancelling the K1 because a student visa is easier to get, that you will reconcile with the fiance once you are in the USA. For the F1, you have to prove you do NOT want to immigrate, that you have strong ties to home and will return after your studies. You have proven the opposite by trying for the K1, so it will be more difficult to get a student visa, especially so shortly after the failed K1.

Sorry for what you are going through. However, I agree with CaryH. You probably had a gut feeling about him but ignored it. We all do it.
You said you've moved on but your post sound like you are very bitter and angry, which is expected, but dont let that become your new image.
Don't allow this man to create a monster out of you. Bitterness and anger does you no good. It only gives you wrinkles and makes you look older.
Don't waste your energy on him. Sounding bitter only makes it appear that you would take him back if he came back.
And don't project that negativity onto your son. If he believes his dad is a superman, go along with it. He will grow and find out who his dad was. You two are his first role models, don't taint one side of the coin for him. Do what you have to legally do.
I wish you all the best.

pch1 got a reaction from MrsBonsu in A reality tv series on k-1 visa on tlc (90 day fiance)
I did watch it and from the first minute I knew this guy was up to no good...I knew he was fake, but what made it stick is the day he want to see a lawyer asking about green card...It happens most the time and it will continue to happen unless laws and rules change to make it hard to stay...I for one would like to see 5 year of proof of living together before applying for AOS for permanent green card and anything less, divorce or separation prior the the 5 years must be reported to USCIS. Oh yeah, some people might say this is not right, what if the marriage really did not work out for one reason or another...Well, let the Immigration and court be the judge of that. This is something for beneficiary to think about that it is not just a walk in the park anymore...
I know of other Tunisian who married an American and played the game for 3 years while living with his wife. He got everything he wanted out of her and you know the rest of the story...Divorced and free man roaming!

$1995 for a lawyer? That is more than enough to fly to Turkey again, meet him, take lots of pictures together and it will look good on the petition as well. You might even come back with some extra change to pay for the process and do it yourself...You don't need an ambulance chasers for sure.

pch1 reacted to Pitaya in How many pages of tax return to include
If you want to include the Fed ITR, be sure to include all schedules, tables, forms, etc....the whole enchilada. For this very reason many folks obtain and submit the IRS-provided tax return transcript for the necessary year. They are free, a lot less paper, and accepted by USCIS, check out this link for more information: https://www.irs.gov/Individuals/Get-Transcript. USCIS is not interested in state ITRs.
This is an often discussed topic, use the forum search function for further information.
Good luck on your immigration journey.
