    I had a 601 waiver expedited. Look back on this site to  late 2014. My husband ( soon to be divorced) entered the U.S.January 2015. 
    My reason for expedite was my unemployment was ending. I needed him here to help pay the bills.  My lawyer told me it would never get approved...we filed they waiver late August 2014 and the expedite was approved October 2014 ( if my memory serves me)  it's in my timeline I believe.

    Well, usually you should contact the consulate yearly to let them know you are still perusing the waiver option. A simple phone call to the USCIS will let you know if the I130 is still active. Why would you wait for them to answer an online form??????  They probably won't answer specific case questions anyway.  Just by entering the case number on the automated system should give you the active or inactive answer. 
    Waivers are not just filling out a form.  There's also a fee. The consulate would have given you a paper during the interview letting you know which waiver your husband is eligible for. It sounds like you're guessing.  Was your husband removed?  He might need 2 Waivers. I 212 and I 601.  
    That's why you need to speak to a tier 2 person at the USCIS or someone at the consulate.
    If the I130 is not active, they might require you to start over.

    She has no chance to stay legally in the US no matter how long she waits here. She needs to go back home.

    You said he found another woman so I doubt she will marry the petitioner. She is illegal and deportable every single day she stays in the US.

    You say you can not afford rent / this is more of a problem than expedite case
    you need to pass the income requirements / paying out most of income for child care and not having your own place to live will mean you may need cosponsor
    i am not trying to discourage you / just be aware of the poverty income requirements for spouse visa and be prepared

    If you don't qualify for food stamps then you're not that bad off.  They give them out like candy.. If you live in the U.S...there are programs you can apply for. 
    You have to live your life here and now. My husband meant everything to me too but guess what..?   Life still goes on.  
    Don't play the victim.  You're the mother to these kids. Stand strong and support them. What Will you do if the waiver is denied because of the New immigration policies?  Then what?  Het yourself square here and if he eventually joins you..Then that Will be nice... Trust me....I've lived this...nobody told me how stupid I was for waiting..it turned out horribly and my kids we're the ones watching...they saw me wait. FOR NOTHING ....4 years. Biggest regret of my life
     
    Do what you want...but don't play the victim. The government is not responsible for who you married...it's not his right to be here..you have to follow the rules...

    I would assume because they are tightening the immigration process.  You should probably assume a longer processing time..

    there isn't a second interview. The uscis sends the waiver approval to the embassy. The embassy contacts the applicant. They send a letter(email) requesting a new medical and police report and whatever else they need. You drop it off at the embassy. Then a few days later they issue the visa.

    Of course there were more updates to the CEAC after December 30th. His visa was issued on January 12th so there were probably 4 or 5 more updates and of course the status change to READY, then AP then Issued. You will never know what the updates are. It could be just them entering a date or entering follow up info in a field. Or the file moving from one officers desk to another officers desk. I had tons of updates. I have no idea what they were doing. I was just glad someone was working on it after spending 11 months at the USCIS with no way to even know if someone was working on my file Married March 9, 2013

    not true. I just went through this. He is out of the country. Uscis told me face to face that if he tries to come back, the CBP officers will have access to the fraud report and will pull him into secondary questioning and he will likely be turned around and sent home. Someone from the state dept told me they may even take his greencard since he only has 4 months left before it expires. Words do stand up at the uscis. Don't be so quick to dismiss them. Showing up to a face to face meeting and presenting your case makes a huge difference. And they told me once fraud is reported, it's unlikely he will ever get a 10 year greencard or even another tourist visa for that matter. Of course my ex had a previous overstay that we had to get waived...just telling you what was told to me. I actually came here for advice when this first happened and was given 90% wrong advice. I unfollowed this forum but somehow I got a notification for this post...go figure...I'm not trying to be the bearer of bad news or nasty. Follow your heart. If you feel you have a case, then get a lawyer and fight.

    not sure why you think I was attacking her. We went through the i130 process together. It wasn't an attack. Not cool! I was actually agreeing with her. She took a beating from the nvc . I know her story. Smh

    I don't have to defend myself. I didn't do anything wrong except trust him. Inl just found all this out in the last 2 weeks. He and I went to Costa Rica together on May 265th and the day before we were supposed to come back.( June 1).he told me he isn't coming back. Then he said he was ..then he wasn't.I came home alone and he said he would fly back on June 20th. During those three weeks..he said he would be back 100 times..then sent a message for me to forget him and he wasn't returning..then got a call the19th saying he will be back the next day and that he loves me. Then he never went to the airport. I received a text saying he wouldn't be back. That's when I started asking questions. Seems I was the only one who didn't know. there is more to the story.
    Btw. Infidelity is not something I signed up for. I was completely into the marriage. He used me to get a greencard. Say what you want. It was fraud. I don't want comments on whether it was fraud or not. I want info on a divorce.

    no...I'm not planning on getting married to another Costa Rican ..heck no. The marriage is not registered in Pennsylvania. Sooo....and I guess it would be nice to sit on the divorce for a while. And if he happens to get the girlfriend pregnant and produce a child while he's still technically married...that could cause a big problem for him. My mom told me to chill out for a while. Why should I have to put out one more dime for this man?

    Zero evidence. He would never combine money. He did alot of things behind the scenes that I just found out about. Bought property in costa Rica and recently transferred everything out of his name to avoid spliting anything with me. He told everyone in costa Rica that he has a work visa. The community he lives in all know he has been with the girlfriend since 2011.. I know that's a fact. The girlfriend told me. Recently. Other friends saw her Facebook with pics of them together. His family sent text messages with this info. His intension was to get the permanent greencard .divorce me and then bring the girlfriend here. Her sister is here. Nobody knew he was married. The gf sister saw him and I together...was told by my friend we are married..she says ...no, that's my sisters boyfriend. She's waiting for him in costa Rica. My friend said ...no, they have been married for 3 years. Of course now I think back to many things I should have seen. I found his old cell phone with the girlfriend phone number. From the day he entered to recently..he made a call everyday to her..and many texts. I had my friend call the number.. The girl let loose. There is so much more that I found out. Im not gonna get into it. I want to know if there are any attorneys who practice in the U.S. and costa Rica who can help me here.
