Technically, you are in the adjusting status, and you're not a resident yet.
You can't pick any Schengen state to apply for a Schengen visa. It must be the country you spend the most time in your visit.

First of all, your lawyer screwed you big time for recommending you to leave the U.S having known you overstayed your visa. Had you stayed and adjusted your status, you would have become a legal permanent of the US.
Unfortunately, there is no waiver for you to overcome your 10 year ban, which was automatically triggered once you left the US.

As long as your absence from the US is less than 6 months, it shouldn't break your continuous residence required for naturalization.

Your children don't become US citizens automatically.
You can file for CRBA (Consular report of birth abroad) for any child before the he/she turns 18, and you have to satisfy a certain US residency
requirements to pass citizenship to your child.
If you sponsor your children to become permanent residents, only two of your children, the 13 and 19 year old, qualify as immediate relatives, so they have their visa available to them immediately. The two adult children are out of luck, and they have to wait for 7 year for a visa.
The 13 year old can becomes US citizen once he reaches US soil as he is a child permanent resident of US citizen. You can file for his passport and/or certificate of citizenship. Your other children will need to apply to become naturalized US citizen if they want to once they have been a green card holder for 5 years.
I don't believe you can revive the I-130 once it is terminated and dead, so you have to file new one.
    Good luck!

That was a blatant lie when you applied for a student visa. If you stated the truth about your parents, your visa would have been denied.
You never know if they will conduct a check on the visa history. But at the interview, if the interview officer doesn't bring it up, don't talk about it. Only answered what is asked at the AOS interview, DO NOT volunteer additional information.
If the officer working on your case finds out about it, your chances of getting a green card might not be good. A waiver maybe required to overcome the material misrepresentation.
    Good luck.

EAD = Employment authorization document or work permit is required to work in the US legally. A person with an immigrant visa will become a permanent resident (green card holder) when he/she enters the US, and doesn't need a work permit because that person is already authorized to work and live permanently in the US.

The kids can gain the citizenship by applying for certificate of citizenship or US passport. Their green card and your certificate of naturalization will be required for their citizenship application.

A person can naturalize under the 3 year rule marriage base only if he/she is still married and living with the same US citizen spouse

zkt101 got a reaction from Harpa Timsah in US Citizen Wife wanting divorce after 5 years of marriage. Never filed AOS - I am visa overstay. No valid ID. Help!
Let this be a lesson to everyone. If you have a chance to do a job as important as filling for green card, you do it at first opportunity. You have yourself to blame here for not doing it over the last five years. Your best chance of staying in the USA is to reconcile with your wife and make your marriage work again, and then you can file for green card based on marriage. But if things don't work out between you and your wife, and you get divorced, you should be able to obtain a new passport from the Chinese consulate and leave. Hong Kong is a nice place to live, way better than China Mainland, and if you used to live in and have the right of abode in Hong Kong, you do not lose that status.

You should have filed the tax returned as married since you're married. Changing your tax record is the right thing to do. If you keep the tax record as it is, you might have run into problems with USCIS when it comes time for N-400 filling under marriage rule.

You can petition for your mom, an immediate relative, and it takes about a year, but your sister is in a different category, and it takes about 12 years or longer, doesn't matter how old she is. The best option is to petition for your mom, then she would file for your sister once she becomes permanent resident.

I beg to differ. She might have an easier time if her previous marriage was genuine and ended properly. She did not try to stay in the US to hang on to the green card. So if her new relationship is genuine, I don't think she has any problem getting the visa. Go for it OP.

You might run into a problem with USCIS as your filing as head of household is considered unmarried or divorced or legally separated. You might want to change your tax filling status before proceeding with citizenship application to avoid future complications.
