    It sure is hard sometimes coming to the US legally. Illegally you get a phone, money card and transportation.

    You don’t have not one photo, nor any witnesses. That sounds odd, and only one visit. While photos are not in totality used as evidence, something raised an eyebrow thus the RFE. So you met, went to a Hotel for xxxx amount of days, never once took a photo and bo one witnessed this “just heard of it”. Were both your names on the hotel receipt. Any documents together with both names perhaps.
     
    Maybe making a second trip might help and re-filing 

    Clearly USCIS has doubt a meeting took place 🤷🏽‍♀️

    How about dialing down the sarcastic and belligerent attitude?  People here are trying to help you and are spending time and effort to give advice for free.  That advice could be based on assumptions from similar cases and incomplete information as no one here can read minds nor have the clairvoyance to know all the details of your case.  Also, the advice that may not apply in your case, may be useful to others reading this thread and for whom it is not too late to avoid an RFE.

    This looks like the standard RFE you get when you don't include evidence of meeting within 2 years of filing. As others have stated, passport stamps, boarding passes, visas, etc. that show you were in the same place at the same times within the 2 year period mentioned in the RFE. Photos like you said are pretty much useless, so concentrate on the good hard evidence.

    This is 100% inaccurate.  The decision was NOT up to the interviewer.   The LAW states that a K1 couple MUST marry within 90 days, else an I-130 package must be also submitted.  There is NO discretion.....besides, there were other options.  The couple could have been married within 90 days.    The decision has been made...the case was denied. 
    The best solution would have been for the couple to simply submit an I-130 package along with the I-485.....It would have been a very, very simple solution.......Exactly how did Covid affect their ability to submit an I-130.?

    Sorry about that. File a complete I-485/I-130 package and she can stay beyond the 33 days.

    Suspicion alone doesn't warrant guilt. I would never hand over my phone or laptop for a search. If I'm giving a metal waiting room, so be it. There still needs to be reasonable Suspicion, even for federal agents and your right to privacy is not cause.
     
    Secondly, move all your sensitive stuff, naked photos, bank documents, credit card info into your secure folder with a different pattern or security acces than your standard. This is in the event you have an agent force your thumb or face to your phone to unlock it, I've witnessed it happen from street cops, I would never put it past the corrupt CBP officers I've seen.
     
    During the last administration I was held in secondary for 4 hours after my solo backpacking trip to Egypt. They kept asking the same questions over and over and finally asked me "what Arabic ethnicity are you? While holding my US passport showing my very clearly German last name. I asked to see a supervisor and my lawyer and they finally let me leave.
     
    So they can and probably will make your life miserable, but that doesn't mean you should comply with something unacceptable because the government is corrupt. I don't ever comply with any search for the simple matter of not wanting to, I don't care if they think it's suspicious or not.
     
    Obviously the rules for a USC are different but that doesn't mean they're in the right either.

    I shouldn't need a reason to refuse the government's meddling with my personal and private data.
     
    If they think they have a good reason to suspect me in any way, which they shouldn't, they can get a warrant. At least that's how it should be done, and I understand that at the border there might be different laws and authorities given, so that's why I am here asking.

    This is not very constructive and does not answer the OP's question.
     
    Doctors and lawyers may have confidential client information.  Corporate employees may have confidential emails.  Or it could just be a matter of privacy, like discussing medical conditions with close family.
     
    @BananaShoes, from what I've read, yes, you can refuse to give CBP access to your phone/laptop. But you can be detained for a while and CBP will give you a hard time.  You can request a lawyer, but, unlike US police and courts, CBP is not obligated to provide you one.  And if you are not a USC or LPR, you can be refused entry.

    I'm not sure why you are trying to play the victim, and expect to get special treatment when you seem to be taking no responsibility for your actions.
     
    When you left the Philippines recently, you had to sign a BI declaration form which stated you understood the risks of traveling and accepted any possible delays that may happen due to the pandemic. This is now one of them. You accepted this possibility.
     
    Also you could have returned a long time ago from the USA, it was entirely your choice to stay as long as you did. The lockdown in PH did not stop incoming flights for ROF.
     
    To now think you deserve some free pass to get back to the US after staying there so long is ridiculous.

    Hi, You can always call the Philippine Embassy in Mexico and ask for assistance and inform them with your situation and that you are stuck etc. in Mexico,  I am pretty sure that they will help you to go back home, if you really wanted to go home. Yes, Philippines had lockdown, but it always welcome back Filipino citizen until that current memo. But still you can always ask for help, let them know that you are in distressed and had nothing in Mexico.  NG

    Your story is very confusing. Something is not adding up . I hope you dont leave the important part of the story in order for all members  to reply with your concern correctly and
    YES, You can enter back as a filipino citizen to the Philippines. I do not know of where you get that information that you could not go back home. NG

    Having previously filed for a B2 would not have caused the K-1 to be denied......something is wrong there.  Besides, her brother could not have filed an application for her.  Anyway, getting married right after a K-1 denial would not, in itself,  affect a spousal visa.

    This is one case when an attorney would have been beneficial.  A competent lawyer would have told you that you were ineligible to adjust.  If you had come here first, we would have also told you.

    The case was denied after review by the USCIS immigration Officer at the time of adjudication.
