From a data analysis standpoint we are not a very good sample at all. In particular, we are not random. VJers are people who have computer access on a regular basis, we are probably more proactive than the average joe. We are also people who for the most part filed the cases ourselves. And we are those folks who just happened to come across this site in the process of filing, actually set up an account and updated a timeline. Not random at all! In any case, good luck!

Actually, check your facts about the education of Federal workers before you make statements like that. I'm a Fed, and proud of being a public servant...and hold an advanced degree from an Ivy League institution. Most of the other Federal workers I know do actually hold at least Masters degrees, and most of the support staff hold at least a bachelor's degree. A huge amount of the overhead actually goes to pay pensions for retirees who had it MADE under the previous Federal retirement system, us current Feds have a much leaner and less expensive benefits package from healthcare to retirement. And you can believe I pay my share of the health care cost (approx $250 a month!).
I understand everyone's frustration at USCIS...but not all Federal workers are overpaid and receive fat benefits packages for doing nothing. I put in my 9 - 12 hours a day just like private sector and get paid fairly for my profession. However, I actually work very hard to make sure I'm serving my country and managing taxpayer's dollars the right way. I can't say the same for every part of the Government, but I can say... if you're currently looking for government work..you better at least have a bachelor's degree and a whole lot of experience because you won't even make the certification list for a position if you don't.

I didn't laugh at all.
When you live in a place where racial tension is still evident and deal with it too many times on a daily basis, it's hard to find stuff like this humorous. While I understood where Pepsi was coming from with their marketing strategy, they definitely showed poor judgement by making the jogger white. I sat there and said to myself, "Oh no they di-int!"
As much as I love seeing congress people putting our tax dollars to good use on relevant issues such as Super Bowl commercials, I have to agree with the congresswoman that Pepsi showed poor judgement. I won't go so far as to say it was demeaning and how dare they show that during Black History Month, but it was a poor choice, nonetheless.

OK - I'll suggest to you that we (you and I) swim in different circles.
Latino youth, all of them, are exposed to La Raza in the USA, and there's linkage between La Raza and LULAC, for free legal and immigration aid.
There's a HUGE marketing campaign with La Raza these last 3 years - the results of which have trounced yer position.
You may wish to question yer demographic group, just to more certain of yer position?

When you filled out the K1 petition did you indicate that you’re SO had a visitor visa that had been canceled ?

I think you've got the right plan.
If USCIS decided to deport you then you wouldn't receive any notice. This is because there is no removal process for you - you waived that when you used the VWP. You would go straight to deportation, which means ICE would take you into custody, interview you once to determine if you want to apply for asylum or refugee status (they have to offer this to everyone before deportation), and then put you on a plane back to your last country of residence.
It's not surprising that you're getting mixed opinions from different attorneys. You'd get varied opinions with any immigration matter, but this one is particularly confusing for attorneys because it's a drastic change from what USCIS used to do, and the policy changes from one field office to another. I would be stunned if going to a different field office now would change anything. You've already been denied once. There's no way another field office would not consider another petition to be a form of appeal.
Like you, I am also expecting a national policy directive to be issued by the director of USCIS. However, I seriously doubt it's going to reverse what the San Diego field office has been doing. If anything, I think it's going to establish that ALL field offices will have to deny AOS for VWP overstays. There have been seven district appeals courts that have agreed with this policy, and not a single one that has disagreed. Even if a case made it to the Supreme Court I doubt they'd reverse the opinions of seven district courts.

Find the thread here where one came on and explained how much pressure they are under, and how little time they have with each petition.

If you are filing the 129, you will have to mail the application back to the US anyway, so why can't you ask someone in the US to just purchase the money order and drop the entire package in the mailbox for you. Simple as that.... You will have a 5 to 6 month wait anyways before the petition is approved.

This isn't the first time someone has called them out like this and I'm sure it won't be the last.
Kathryn, Kriskit, and Otto are are 3 completely useless except against people they may not like on the boards. These three have proven to be very biased and very useless in many circumstances.
Certain individuals will get suspended/threads edited on a whim for daring to say something a bit harsh in threads. These individuals are usually ones that they cannot relate to on a political scale and so therefore are enemies in their head that have to be dealt with accordingly when something is done that they do not like.
Oh the other hand, if someone who possibly shares the same views as they do committs the same infractions or even worse infractions in the form of blatant name-calling/personal attacks, etc. then these people's actions go ignored and go left in place without warning, without removal, and without suspension.
This has been going on against several people and a few have gotten by with far more than others have gotten suspended for less for.
It is deeply concerning for a site of this nature that has so many different ideas and opinions, for a moderator staff to treat certain individuals with favoritsm over others.
You run a good site here and there's no reason why these few moderators should drag its name down like they do. I personally feel (along with a few others I'm sure) think that all 3 of these moderators should recuse themselves from their moderator position and should be replaced with individuals who will treat each situation equally and not based on any type of favortism. A great resource ilke this that has been helpful to so many deserves a fair and just staff to keep it lively and just as helpful, even in the forums that aren't necessarily a part of that process itself. They still reflect upon the site, and that is important.

I don't see how they will issue you a F-1 if you are married to a USC. If you are being truthful on the student visa application, you will probably not be issued an F-1. Your USC husband should have started the process of applying for an approval for a CR1, if you wish to come to the US to live. I am sure the F-1 application ask for your martial status,you need to be truthful regarding this, because if you lie it will come back to haunt you during AOS.

The difference between a right and a privilege, from a legal perspective, is that a privilege is presumed not to exist unless granted by law, while a right is presumed to exist unless revoked by law. From a practical perspective, this means you don't have a privilege until you've asked for it and it's been granted or recognized, while you automatically have a right unless it's specifically been taken away from you.
You have the right to free speech, guaranteed in the US Constitution. You don't have to ask for this right to be granted. If you want to make your speech on my doorstep then that's a privilege you have to ask me for.
You have the right under the Constitution to live, to be free, and to own property. You don't need to ask for these rights to be granted, and the government needs to convince a judge that they have just cause before they can take any of these rights away from you.
If a US citizen had a right to allow their spouse or fiancee to immigrate then you wouldn't need to ask the government's permission for this. You should be able to just bring her here and she'd be allowed to stay unless the government intervened at some point and tried to take that right away from you. It doesn't work that way.
First, you have to submit a petition and prove you're eligible to submit that petition. If the government doesn't find any reason under the law to deny it, then they'll approve the petition. Next, your spouse or fiancee has to submit an application and interview for a visa. If the government doesn't find any reason to deny it, then they'll issue a visa. Depending on the type of visa involved, you may need to ask the government for permission to get a green card. Depending on how long you've been married, you may need to ask the government for permission to lift the conditions on that green card in two years. If your spouse wants to become a US citizen then they have to wait until they're eligible to apply, submit an application and take a test, and if the government doesn't find any reason to deny then they'll grant them citizenship.
The point is that all through this process you will be asking the US government for permission to complete the next step. If, at any point, they find a reason to say "no" then permission will be denied. In most cases, you won't even have a path to appeal the decision.
I don't see any way this could qualify as a right.
Curiously enough, you also have to ask the state government for permission to marry by applying for a marriage license. If they find you're not eligible then they'll say "no".

Hint, immigration does use computer to store and process files. They do not keep paper files as trails. They do have systems that compare business rules against the intent action of an application.

That's precisely the point, they are not "safe and secure" until they file for TPS and their request is processed. You are not going to get anywhere complaining about refugees and asylees (which, by the way, come from a number of countries, not just Haiti). Picking on the underdog just makes you seem like an over-privileged bully. Why don't you target any of the I129 Visas that get processed in two weeks to a month?

Once canceled a case is dead , if you can call USCIS and tell them you sent the letter during a spat maybe they can note the file. If they have already processed the letter you have to start again and pay again but that should be no real problem.
